|a تنبع أهمية دراسة هذا الموضوع في أنه من أشد الأمور حرمة، والتي تتسبب في استحلال المال الحرام والتهرب من الواجب الشرعي والوطني، وفيه يتعرض الباحث لتعريف الطلاق الصوري، والفرق بينه وبين ما يشبهه، ثم يذكر الباحث أسباب الطلاق الصوري ويبين أنواعه، ثم يوضح: الآثار المترتبة على الطلاق الصوري، ثم يذكر الباحث حكم الطلاق الصوري من أجل الحصول على المعاش، أو من أجل التهرب من التجنيد، ثم الخاتمة: وتشتمل على أهم النتائج التي توصل إليها خلال البحث؛ ومن أهم النتائج التي توصل إليها الباحث: أن الإسلام شرع الطلاق كعلاج عند استحالة العشرة بين الزوجين، إن الطلاق الصوري هو: إظهار عقد الطلاق وإخفاء النكاح؛ للحصول على منفعة شخصية أو التهرب من واجب، يحرم الطلاق الصوري؛ لما فيه من الاستهزاء بآيات الله -عز وجل-، الطلاق الصوري واقع ومحسوب من عدد الطلقات.

|b The present study derives its significance from the interdiction of practicing the act it deals with. Such practice leads to regarding unlawful income as lawful, and evading a national duty that is an obligation from the Islamic point of view. The researcher tackles the definition of nominal divorce, mentions the reasons behind it, illustrates its types, and explains the difference between it and other types resembling it. Then, he deals with the effects of this type of 'divorce'. The researcher indicates the ruling on nominal divorce meant for obtaining government pension or avoiding conscription (in compulsory military service). The conclusion contains the most important findings of the study as follows: Islam allows divorce as a cure when it is impossible for a couple to lead a normal life in marriage. Nominal divorce is a case in which divorce is announced and marriage is hidden in order to obtain personal benefits or evade some significant duty. This type of divorce is prohibited in Islam because it mocks the ordinances of Allah Almighty. Therefore, it is considered a true divorce in effect, and counts as one of the limited [three] chances of divorce allowed for a married couple.
