|a هذا البحث يتناول قضية التعريف بثبوت الحكم الشرعي وضبطه في مواضعه وبيان أنه مقصد من مقاصد الشريعة، وذلك عن طريف العلة الشرعية التي جعلها الشارع علامة على الحكم التكليفي، وذلك ليتمكن المكلف من امتثال أحكام الشريعة ليفوز بسعادة الدنيا والآخرة، كما أن العلة الشرعية تعني ببيان مراد الشارع من الأدلة الجزئية، فالعلة العامة تبين أن الشارع أراد باللفظ الخاص العموم، كما أن العلة الخاصة تبين أن مراد الشارع باللفظ العام الخصوص.
