المستخلص: إن بلدنا العزيز، عانى – ومازال يعاني – من الحروب والمعارك، والوضع الأمني غير المستقر نسبياً، وكان لهذه الكوارث – الطبيعية منها والبشرية – آثار سلبية كثيرة، كان منها فقدان أرواح الكثير من أبناء هذا الشعب، وبطبيعة الحال، فإن غالب من يفقد حياته في هذه الأوضاع كان يخلف وراءه أطفاله، يتامى، لا معيل لهم، وسواء كان الشهيد من القوات الأمنية أو من المدنيين، فإن الحال واحد بالنسبة لمن فقد أباه أو أمه أو كليهما؛ فهو فقد سنده الذي يلتجئ إليه في حياته، وفقد معلمه الذي يقتدي به في فترة نشأته، والكلام في هذا الأمر يطول كثيراً، فقد فقَّدَ الكثير أبناء هذا الشعب معيلهم الوحيد، وعاش أفراد هذا البلد مأساة اليتم ومراراته، وشعر الكثير منهم بما يشعر به اليتيم ويحن إليه ويفتقده. وبسبب العادات والتقاليد أحياناً، أو بسبب القوانين والأعراف الدولية أحياناً أخرى، تنتهك حقوق اليتيم، ويقع تحت الظلم، فرأيت أن أكتب في حقوقه، دراسة مقارنة بين ما جاءت به الأديان السماوية في كتبها المقدسة ومصادر تشريعها المختلفة، وبين ما أقرته القوانين الدولية وقوانين الأحوال الشخصية في بلدنا العزيز. وكان مما شدني إلى الكتابة في هذا الموضوع ما أراه حولي من انتشار اليتم بصورة مخيفة، وتزايد أعداد الأيتام تزايداً كبيراً، وقلة الدعم الذي يحصلون عليه على المستوى العائلي، أو على مستوى المنظمات المحلية والدولية، فكان لابد من تسليط الضوء على هذا الأمر، لعل وعسى أن يكون هذا حافزاً للبعض، ومبيناً للآخر ما لليتيم من حقوق على الفرد والمجتمع، فكان عنوان: (بحثي حقوق الطفل اليتيم بين الأديان السماوية والقوانين الوضعية – دراسة مقارنة). ومن الجدير بالذكر أن قالت منظمة الأمم المتحدة للطفولة اليونسيف إن عدد الأطفال الأيتام في العراق يقدر بخمسة ملايين طفل من مجموع نحو 140 مليون يتيم في العالم. وأوضحت اليونسيف في تقرير لها أن 5% من أيتام العالم موجودون في العراق!! وكانت خطتي في الكتابة أن أمهد بتعريف اليتيم في اللغة والاصطلاح الشرعي والقانوني، ثم أعرج على ما ورد في الأديان السماوية (الإسلام والمسيحية) والقانون العراقي فيما يخص موضوعين مهمين ألا وهما: الحث على الإحسان إلى اليتيم وكفالته، وحقوق اليتيم من النسب والرضاعة، وما يتبعها من الحضانة والنفقة والوصاية. وستكون منهجيتي في البحث مقارنة، بما بين الإسلام والمسيحية واليهودية من جهة، وما بين القانون الدولي، وقانون الأحوال الشخصية العراقي من جهة أخرى.

In these situations, he left behind his children. orphaned, unaccompanied, and whether the martyr was from the security forces or civilians, the case is the same for those who lost his father or his mother or both; he lost his support that he resorted to in his life, and the teacher who follows him. In his upbringing, the talk about this matter is much longer, many lost the sons of this poetry B their only breadwinner, and the people of this country lived the trag-edy of orphans and bitterness, and many of them felt what the orphan feels and nostalgia and misses. Because of customs and traditions sometimes. or because of international laws and customs at other times, the rights of orphans are violated and under oppression. In our dear country. I was attracted to write on this subject what I see around me the spread of orphans frighteningly, and the large num¬ber of orphans and the large support they receive at the fam¬ily level, or at the level of local and international organiza¬tions. it was necessary to highlight this matter, perhaps To be an incentive for some, and to show the other the rights of the orphan on the individual and society, was the title: (research rights of the orphan child between heavenly religions and positive laws - a comparative study). It is worth mentioning that the United Nations Children’s Fund (UNICEF) said that the number of orphaned children in Iraq is estimated at 5 million out of a total of about 140 million orphans in the world. UNICEF explained in a re¬port that 5% of the world’s orphans are in Iraq!!! My plan in writing was to prepare the definition of the orphan in the language and legal and legal term, and then I deal with what is mentioned in the religions (Islam and Christianity) and Iraqi law with regard to two important topics: the promotion of charity to the orphan and ensure it. and the rights of the orphan of descent and breastfeeding, and the following Of custody, alimony and guardianship. My research methodology will be a comparison between Islam. Christianity and Judaism on the one hand, and in¬ternational law and Iraqi personal status law on the other.
