المستخلص: يتحدث هذا البحث عن علاقة الأدلة الشرعية بقسميها المتفق عليها والمختلف فيها بضبط الحريات الشخصية، وقد جاء تحت عنوان: (الأدلة الشرعية وعلاقتها بضبط الحرية الشخصية). وهو متعلق بمسألة مهمة جداً؛ وذلك لتعالي الأصوات في الأوساط المختلفة بالحرية الشخصية، ويهدف هذا البحث إلى بيان أن الحرية الشخصية مضبوطة بضوابط الشرع. وليس مراد الباحث بيان ضوابط الحرية الشخصية وإنما مراده بيان أن الأدلة الشرعية من الكتاب والسنة والإجماع والمصالح المرسلة وسد الذرائع وغير ذلك لها علاقتها الواضحة بوضع القاعدة الأصلية في تحديد وضبط ما يعرف باسم الحرية الشخصية. وتكمن أهمية هذا الباحث في أمرين: الأول: بيان الأصل الذي تعود إليه ضوابط الحرية الشخصية. الثاني: أنه فكرة تلتفت أنظار الباحثين إلى مثل هذه الموضوعات العصرية التي طرأت على الساحة المجتمعية وارتفعت بها الأصوات. وفي هذا البحث يلقى الباحث الضوء على علاقة الأدلة الشرعية بضبط الحرية الشخصية، وأن جملة هذه الأدلة يضع قواعد ضابطة يجب أن يتنبه لها الناظر في الشريعة الإسلامية وأدلتها، وأن هذه القواعد الضابطة هي الأساس لجميع الأحكام على اختلافها وتعددها، واختلاف أبوابها الفقهية، وهذه هي النظرة الشاملة للأدلة الشرعية. وقد استعمل الباحث المنهج التحليلي في بيان علاقة الأدلة الشرعية بضبط الحرية الشخصية؛ حيث قام باستخلاص القاعدة الإجمالية من الدليل ثم بيان أثرها في ضبط المكلف وتحديد تصرفاته. وتوصل الباحث إلى عدة نتائج لعل أهمها: اشتمال الأدلة الشرعية على معاني عامة وقواعد ضابطة تعتبر أساساً لكثير من الأحكام الشرعية، وأنه ما من مسألة إلا ولها مرد إلى الأدلة الشرعية تتبين حكمها وتحدد معالمها وضوابطها سواء أكان تفصيلاً أم إجمالاً أم أخذاً من روحه وتضافر نصوصه، وأن الأدلة لها تعلق واضح بضبط ما يسمى بالحرية الشخصية. والله أعلم.

This research talks about the relationship of the forensic evidence with its two parts, which are agreed upon and disputed by the control of personal freedom Applied fundamentalist study. It is related to a very important issue, in order to increase the voices in the various circles of personal freedom, and this research aims to show that personal freedom is regulated by Sharia. The researcher is not a statement of personal freedom controls, but rather a statement that the legitimate evidence from the book and the Sunnah and the consensus and sent interests and fill the pretexts and others have a clear relationship to the status of the original rule in the identification and control of what is known as personal freedom. The importance of this researcher lies in two things: First: Statement of origin to which the controls of personal freedom. Second: It is an idea that draws the attention of researchers to such modern topics that have occurred in the community arena and the voices have risen. In this research, the researcher sheds light on the relationship of forensic evidence to the control of personal freedom, and that the collection of these evidence establishes rules that must be alert to the beholder in Islamic law and evidence, and that these rules are the basis for all rulings of different and multiple, and different doctrinal doors, and this is the view Comprehensive forensic evidence. The researcher used the analytical method in the statement of the relationship of forensic evidence to control personal freedom; The researcher reached several results, the most important of which are: the inclusion of forensic evidence on general meanings and rules that are considered the basis for many of the Shariah rulings, and that there is no question but has a return to the forensic evidence to determine its rule and determine its features and controls, whether in detail or in total or taking from the spirit and the synergy of its texts, Evidence is clearly attached to the seizure of so-called personal freedom.
