المستخلص: الحمد لله والصلاة والسلام على خير خلق الله سيدنا محمد وعلى آله وصحبه ومن والاه ... وبعد" فإن من أهم مقاصد الشريعة: الحفاظ على الدين والنفس والعرض والمال، وحفظ الأمن والجوار، في ظل تعدد الديانات واختلاف المشارب والأفهام، مع الحفاظ على نقاوة العقيدة ومقتضيات التوحيد؛ لذا آثرت البحث في هذا الموضوع وجعلت عنوانه: "الوعي الفقهي بأمن غير المسلمين في الدولة الإسلامية وأثره في تحقيق التعايش السلمي". والتعايش السلمي يقصد به: العيش المتبادل مع المخالفين جنساً أوديناً أو لغة أو أي اختلاف آخر مع المسالمة والمهادنة، والتسامح هو إحسان معاملة الآخر، وإقامة العدل معه، والصفح عن زلاته رجاء هدايته، وهو مطلب ديني وغرض شرعي لا تقوم مصالح الدين إلا عليه، ولا تتحقق مصالح الخلق إلا به. والتعايش من الناحية الدينية يعني: إظهار كل الفرق أو الجامعات ذات الاعتقادات، أو الديانات المختلفة لكافة شعائرهم الدينية بكل حرية وقد ضرب الإسلام أروع الأمثلة في احترام الآخر ونصرته، يتضح ذلك عندما جاء إلى المدينة كما هي جلياً في صحيفة المدينة التي كتبها النبي صلي الله عليه وسلم مبينة في سيرة ابن هشام، وقد وادع فيها اليهود وعاهدهم وأقرهم على دينهم وأموالهم، وشرط لهم واشترط عليهم، وكفل لكل جماعة حقوقها للمجتمع أمنه واستقراره؛ وواجباتها تجاه الأمة؛ حتى يضمن النبي صلي الله عليه وسلم حيث يأمن فيه كل فرد على نفسه وماله وعرضه، ويمارس معتقداته في جو من الحرية والأمان. بالإضافة إلى أنه قد ينظر للإسلام على أنه دين العنف والتطرف والقتل. لذا نحن بحاجة إلى تصحيح صورة الإسلام وبيان محاسنه، من أجل ذلك جاءت هذه الدراسة لتبين عظمة الشريعة الإسلامية فيما كفلته من حقوق أمنية لغير المسلمين. وذلك من خلال الوعي الفقهي بحفظ دماء غير المسلمين وأموالهم وأعراضهم وحريتهم الدينية

Achieving peaceful coexistence" Peaceful coexistence means: living together with those who violate the race, language, language, or any other difference with pacification and appeasement, and tolerance is the benevolence of treating the other, the administration of justice with him, and forgiveness of his missteps, to please his guidance. The interests of creation are realized only by it. Coexistence from a religious point of view means: showing all groups or universities of beliefs, or different religions, all their religious rites freely. Islam has set the most wonderful examples of respecting and supporting the other. This is evident in the newspaper Al-Madinah written by the Prophet When he came to Medina as it was shown in the biography of Ibn Hisham, he called the Jews and their covenant and approved them on their religion and their money, and stipulated for them and stipulated for them, and guaranteed to each group Its rights and duty towards the ummah, so that the Prophet assures the community of its security and stability. Where everyone believes in himself, his money and his offer, and practices his beliefs in an atmosphere of freedom and safety. In addition to that Islam may be seen as a religion of violence, extremism and murder, we need to correct the image of Islam and demonstrate its merits, for this reason this study came to show the greatness of Islamic Sharia in its security rights for non-Muslims. And this is through the following investigations: Juristic awareness of preserving the blood of non-Muslims, their money, their symptoms and their religious freedom
