المستخلص: تتميز الوكالة بأنها عقد غير لازم من حيث الأصل، باستثناء الوكالة المتعلقة بحق الغير فإنها تكون لازمة وبالتالي لا يجوز للموكل عزل الوكيل، كما لا يجوز للوكيل من حيث المبدأ عزل نفسه لتعلق حق للغير بهذا النوع الخاص من الوكالات. وقد استخدم المشرع الأردني ميزة لزوم العقد التي يتمتع بها عقد الوكالة غير القابلة للعزل للتوكيل بإتمام إجراءات البيع والفراغ في الأموال غير المنقولة كاستثناء على منع التصرفات العقارية خارج دوائر تسجيل الأراضي المختصة التي قررتها القوانين النافذة في الضفة الغربية في فلسطين والتي تبنت مبدأ شكلية التسجيل كركن انعقاد للبيع والتصرفات العقارية في الأراضي المشمولة بالتسوية، وستتناول هذه الدراسة التعريف بماهية الوكالة غير القابلة للعزل وطبيعتها القانونية، ومن ثم البحث في الآثار القانونية لهذه الوكالة وأثرها على الغير ممن ترتبت له حقوق عينية عقارية مسجلة في تاريخ لاحق على تاريخ تنظيم الوكالة غير القابلة للعزل، مع بيان موقف التشريعات النافذة في الضفة الغربية بفلسطين وموقف القضاء من آثار تعلق حقوق الغير بموجب الوكالة غير القابلة للعزل وأثر ذلك على الأمن العقاري ومقتضيات استقرار المعاملات العقارية.

The power of attorney is recognized as a non-binding contract by origin. However, the power of attorney that is related to the rights of others breaks the original norm and becomes binding, whereby the principal shall not dismiss the agent. The agent shall not dismiss himself in principal as the rights of others are attached to this special power of attorney. The Jordanian legislator used the contract-binding feature of the irrevocable power of attorney to grant the power to complete sale and transfer of immovable property as an exception to prevent real estate dealings outside the competent land registration departments authorized by the effective laws in the West Bank in Palestine which adopted the principle of problematic registration as a pillar to conclude the sale and real estate dealings of the territories covered by settlement. In this study, a definition of the irrevocable power of attorney and its legal nature will be provided. The study will then discuss the legal implications of this power of attorney as well as its effects on others who were entitled to real estate rights in rem registered in a date later than the date of organizing the irrevocable power of attorney. The study will clarify the position of the legislations effective in the West Bank in Palestine and the position of the judiciary from the implications of irrevocable power of attorney with regard to the rights of others, as well as its impacts on the real estate security and the requirements of stability of real estate transactions.
