الحمد لله رب العالمين وأفضل الصلاة وأتم التسليم على سيدنا محمد وعلى آله وصحه أجمعين: فقد جاء هذا البحث ليدرس المسائل الفقهية المتعلقة بالصائل، فكان على مبحثين: فبين في المبحث الأول تعريف الصائل وحكم الصيال والأدلة عل تحريمه، ثم تطرق إلى مشروعية دفع الصائل، وتناول شروط دفع الصائل، ثم ذكر الوسائل المتعلقة بدفع الصائل ووسائل الإثبات. وأما في المبحث الثاني فقد ذكر المسائل الفقهية المتعلقة بالصائل، فناقش مسألة حكم الصائل إذا كان مكلفا، وحكمه إذا كان غير مكلف وحكمه إذا كان بهيمة، ثم تعرض إلى حك الدفاع عن النفس، والعرض، والمال، ودرس أيضا حكم الدفاع عن نفس الغير وعرضه وماله، وختم البحث بالحديث عن حكم الصائل المتطلع على عورات البيوت.
Praise be to Allah the Lord of the worlds and may the blessings and peace of Allah be upon the most honored of messengers our master Muhammad and upon all his family and companions. This research came to study jurisprudential issues related to the questioner, and it was based on two topics: In the first topic, he explained the definition of the questioner and the ruling on the conduct and evidence for its prohibition, then he touched on the legality of paying the questioner, dealing with the conditions for paying the questioner, then mentioning the means related to paying the matter and the means of proof. As for the second topic, he mentioned the doctrinal issues related to the questioner, then he discussed the question of the rule of the questioner if it was costly, his rule if it was not expensive, and his rule if he was beast, then he came to the rule of self-defense, supply, and money, and he also studied the rule of defending and displaying the soul of others And his money, and concluded the search by talking about the rule of the one who looks at the faults of homes. Then the researcher mentioned in the conclusion the most important results that he reached.
