حاول هذا البحث بيان أثر سد الذرائع في تحقيق أمن المجتمع ومنع الاختلالات الأمنية؛ إذ تناول في مبحثه الأول معنى الذرائع في اللغة واصطلاح الأصوليين، ثم بيان أنوع الذرائع وأركانها، ومذهب القائلين باعتبارها حجة ومصدرا للتشريع وأدلتهم في ذلك، وكذلك مذهب القائلين بعدم اعتبارها حجة ومصدرا للتشريع، وأدلتهم فيما ذهبوا إليه، ثم أمثلة على سد الذرائع من المذاهب الأربعة. ثم تناول في المبحث الثاني أثر سد الذرائع في تحقيق الأمن للمجتمع، ومنع حدوث أي خلل أمني، وذلك من خلال بيان النتائج المترتبة على قتل الجماعة بالواحد، وإقامة حد الحرابة على أصحابها، أيضا أثر السمع والطاعة للحاكم الظالم وعدم الخروج عليه بالسيف أو إثارة الفتنة حوله، وفائدة منع القاضي من أخذ الهدايا ممن لم تجر عادته بمهاداته، ومنعه من القضاء والحكم بين الخصوم حال غضبه أو جوعه أو حزنه، وكذلك بيان الثمرة الناتجة عن القول بتحريم ترويع الآمنين وإشهار السلاح في وجوههم، وتحرم بيع السلاح زمن الفتنة والحرب، أيضا منع غير الكفء وغير المختص من ممارسة عمله أو مهنة ليست في تخصصه. وخلص البحث إلى أن قتل الجماعة بالواحد، وإقامة حد الحربة على فاعلها، ومنع إقامة الحدود من عامة الناس يحقق للمجتمع الأمن والاستقرار. ومثل ذلك طاعة الحاكم الظالم وعدم الخروج عليه يمنع سفك الدماء وإضاعة مزيد من الأموال وقتل الأنفس المعصومة، نحو ذلك عند منع القاضي من قبول الهدايا والحكم حال الغضب يجعله أكثر إنصافا وعدالة وحفظا لحقوق الناس ويجعل المجتمع آمنا. ومثل ذلك في منع ترويع الناس، وتحرم بيع السلاح في الفتنة ومنع غير الكفء.
This research attempted to show the effect of bridging the excuses in achieving community security and preventing security imbalances. In the first chapter, the research deals with the meaning of excuses in the language and terminology of fundamentalists, then outlines the types of pretexts and their pillars, and the doctrine of those who say as an argument and a source of legislation and the evidence in that. Likewise, the doctrine of those who say it is not an argument and a source of legislation. Besides, it guides them as they went to. It shows examples of bridging excuses in the four sects. It discusses in the second chapter the effect of bridging the excuses in achieving security for the community, and preventing any security imbalance, that is by showing the consequences of killing the group by one and setting an end to its owners. Likewise, the effect of obedience to the unjust ruler and not rebel against him with a sword or stirring up strife around him. And the benefits of preventing the judge from taking gifts from those who were not used to his testimonies, and preventing him from judging and ruling among opponents if he is angry, hungry or sad, that can result from the statement that it is forbidden to intimidate the security and community rights and to threating them by weapons. Also, The prohibition of selling weapons during times of crises and war. Likewise, preventing the non-competent and non-specialist from practicing his work or profession that is not within his specialization. The research concluded that killing the group by one, establishing the punishment on those who do bad deeds, and preventing the establishment the punishments by the general public will bring security and stability to the community .Also , the obedience to the unjust ruler and not going out against it prevents bloodshed, wasting more money and killing infallible souls, towards that when the judge is prevented from accepting gifts and ruling in anger that makes him more fair, just, and preserves people's rights and makes society safe. And like this in the prevention of intimidation of people, and the prohibition of selling weapons in strife and prevent incompetent and unqualified people from practicing work out of their specialization.
