|a إن الاحتكام إلى الميزان المقاصدي أحد الأبواب التي يطرقها الباحث لتغليب الآراء الفقهية خاصة في المستجدات والنوازل، وهو ما قصدته في هذا البحث بعد عرض الخلاف في الحكم الفقهي، حيث سيتناول البحث مفهوم هذه العملات، ثم سيعرض أبرز الأقوال الفقهية حولها، ثم سيقوم بعرض هذه العملات على الميزان المقاصدي للخروج برأي فقهي بناء على تلك المقاصد، وستتبع الدراسة المنهج الوصفي والاستقرائي التحليلي، ومن أهم نتائج البحث أن مفاسد تلك العملات غلبت مصالحها، والتي هي في الحقيقة منافع شخصية لا مصالح كلية، وقد أوصت الدراسة بضرورة سن التشريعات القانونية، في ضوء ما توصلت إليه الدراسة، وذلك تحقيقا لهدف حفظ المال الخاص والعام، وإيجاد بديل شرعي يحاكي هذه العملات، وأوصت بضرورة تصحيح مسار هذه العملات خاصة في ظل ما تتعرض له من غياب لسلطة إصدار رسمية وما ينتج عن غياب ذلك من مشكلات حقيقية لا ريب.

|b Researcher: Louai Dibo Al Mamar,Associate Professor: Luqman Bin Hj Malaysia- -Nor Fahimah Binti Mohd Razif Associate Professor:-Abdullah Malaya University- Academy of Islamic Studies- Department of fiqh & Usul. One of the things that the researcher relies on to prioritize jurisprudential opinions is the rule of Sharia, namely, in today’s matters. This is what the researcher has intended after bringing the issue of dispute to the jurisprudential rule. The research will deal with the concept of these virtual crypto currencies, then it will present the most prominent jurisprudential opinions about it. Eventually, the research will present these crypto currencies to the principle of aim and purpose to come up with a jurisprudential opinion based on those aims and purposes. The study will follow the descriptive and inductive analytical approach, and one of the most important results of the research is that the corruption of the virtual crypto currencies outweighs their benefits, which are, in fact, personal gains rather than total benefits. The recommendations of the study revolve about enactment of legislations in order to achieve the goal of preserving private and public money, and to find a legitimate alternative that simulates these currencies. The study has also recommended the necessity of rectifying the destination of these virtual crypto currencies, especially in the light of absence of an official issuing authority and the fundamental problems that result from this absence.
