المستخلص: تهدف هذه الدراسة إلى التعرف على السلطة التشريعية في المملكة العربية السعودية بجميع مكوناتها بصفة عامة، وتسليط الضوء على مجلس الشورى كأحد مكونات السلطة التشريعية بصفة خاصة؛ بحيث تستعرض أنواع الأنظمة في المملكة، ومكونات السلطة التشريعية، وتناول دور مجلس الشورى في العمل التشريعي، ومراحل العملية التشريعية.
وقد انتهت الدراسة إلى عدد من النتائج؛ منها أن السلطة التشريعية في المملكة سلطة مشتركة، تتوزع بين الملك ومجلس الوزراء ومجلس الشورى. ويعد مجلس الشورى ركنا أساسيا في السلطة التشريعية، وأحد أهم مكوناتها، ويقوم بدوره في العمل التشريعي من خلال دراسة ومراجعة ما يرد إليه من مجلس الوزراء، أو من خلال ما يقترحه ويدرسه ابتداء.
كما قدمت بعض التوصيات المؤمل منها أن تكون داعمة وبناءة في تطوير دور مجلس الشورى في العمل التشريعي بما يعزز من فاعليته وكفاءته في تحقيق أهدافه؛ ومن أهمها: مراجعة الجوانب التنظيمية المتعلقة بالعملية التشريعية، والعمل على تطويرها، بما يعزز تفعيل مبدأ الفصل بين سلطات الدولة الثلاث، ومبدأ تحقيق التعاون فيما بينها بما يحقق المصلحة العامة، والاستفادة من الممارسات العالمية المتقدمة في هذه الجوانب. وتقييم دور مجلس الشورى والمساحة المتاحة له في ميدان العمل التشريعي عندما يضطلع بدوره في العمل التشريعي، وتعزيز دوره على غرار عدد من الممارسات الدولية في العملية التشريعية، ومن بينها بعض الدول المجاورة كالأردن والبحرين. وتطوير قواعد عمل مجلس الشورى ولجانه، وكذلك تطوير الضوابط المطلوب مراعاتها قبل تقديم المقترحات التشريعية من أعضاء المجلس أو لجانه.


This study aims to learn about the legislative authority in the Kingdom of Saudi Arabia with all its components in general and to shed light on Majlis As-Shura (The Consultative Assembly) as one of the components of the legislative authority in particular. It reviews the types of systems in the Kingdom, the components of the legislative power, and deals with the role of Majlis As-Shura (The Consultative Assembly) in legislative work and the stages of the legislative process.
The study concluded with a number of results; among them is that the legislative authority in the Kingdom is a joint authority, divided between the King, the Council of Ministers, and The Consultative Assembly. The Consultative Assembly is a cornerstone of the legislative authority and one of its most important components. It performs its role in legislative work by studying and reviewing what comes to it from the Council of Ministers or through what it initially proposes and studies.
It also presented some recommendations, which are hoped to be supportive and constructive in developing the role of The Consultative Assembly in legislative work in a way that enhances its effectiveness and efficiency in achieving its objectives, the most important of which are: reviewing the organizational aspects related to the legislative process, and working to develop it, in a way that enhances the implementation of the principle of separation between the three state authorities, the principle of cooperation among them in the public interest, and benefiting from advanced global practices in these aspects—evaluating the role of The Consultative Assembly and the space available to it in the field of legislative work when it assumes its role in legislative work, and strengthening its role similar to several international practices in the legislative process, including some neighboring countries such as Jordan and Bahrain—developing the rules of work of The Consultative Assembly and its committees and developing rules to be taken into account before submission of the legislative proposals by members of the Council or its committees.
