المستخلص: تناولت هذه الدراسة الضوابط الأصولية وأهميتها في ضوء استحضار أسباب النزول، ذلك إن فهم النصوص ومعرفة الضوابط الأصولية والآليات المتعبة في فهم المراد الشرعي والأحكام المتعلقة به، يجنب العلماء الانحراف الفكري والتأويل الفاسد لتكييف النص على حسب الأهواء، ويعمل على ضبط الأحكام بعيدًا عن الزيغ والتحريف، ويساهم في جمع كلمة الأمة ونبذ الفرقة والاختلاف، حيث برزت مشكلة البحث في بيان الضوابط الأصولية ومعرفة أهميتها في ضوء استحضار أسباب النزول. حتى يفهم الضوابط الأصولية وأهميتها في ضوء استحضار أسباب النزول بفهم صحيح، بهدف التعرف على الضوابط الأصولية. وأهمية الضوابط الأصولية في فهم النص. ومعرفة أهمية الضوابط الأصولية في ضوء استحضار أسباب النزول. واتبع الباحث المنهج التاريخي والاستقرائي والتحليلي والاستنباطي، وقد توصل إلى عدد من النتائج والتوصيات: من الأسباب التي أدت إلى الانحراف في الفكر والاعتقاد والسلوك لفهم النصوص وضبطها في عصرنا الحالي، وأدت إلى التكفير واستباحة الدماء والأموال والأعراض، هي الأخذ مباشرة من القرآن الكريم دون الرجوع إلى أقوال العلماء أو التمكن من العلوم الشرعية. أشرف العلوم ما ازدوج فيه العقل والسمع واصطحب فيه الرأي والشرع، وعلم الفقه وأصوله من هذا القبيل. لقد وضع العلماء القاعدة العامة: "تغير الفتوى واختلافها بحسب تغير الأزمنة والأمكنة والأحوال والنيات والعوائد". ظهور فقه الواقع عند مقولة سيدنا عمر رضي الله عنه المشهورة: (أما والذي نفسي بيده لولا أن أترك آخر الناس بَبّانا ليس لهم شيء ما فتحت على قرية إلا قسمتها كما قسم النبي صلى الله عليه وسلم خيبر ولكني أتركها خزانة لهم يقتسمونها). من فهم لسان العرب في مخاطباتها، يستطيع أن يفهم الشريعة، وإلا فقد لصقت به شبهة الجهل بهذه الشريعة. أن مصدر العقيدة عند السلف هو الكتاب والسنة فهي توقيفية، وأن هذه العقيدة واضحة سهلة فطرية ثابتة لا تتغير مع الزمان، وهي وسط بين التفريط والإفراط في كل شيء. على الدارسين والباحثين إجراء المزيد من البحوث لإستكمال جوانب الموضوع واستقصاء مسائله بجهد كبير لما يستحقه هذا الموضوع. ولتوضيح المفاهيم الشرعية والأحكام المتعلقة بالموضوع وذلك لنتجنب الانحراف الفكري والتأويل الفاسد. حتى ننعم بالفكر السليم والفهم الصحيح للنصوص ومعرفة الضوابط الأصولية.

The scholars have established the general rule, The fatwa changes and varies according to times, places, conditions, intentions and returns, The appearance of the jurisprudence of reality in the famous saying of Our Master Omar: ,But i am in his own hands, but i would not have left the last people in Our Building with nothing that opened up to a village that was divided, as the Prophet Khyber divided, but I leave it to them as a closet for them to share, Anyone who understands the tongue of the Arabs in its discourses can understand sharia, otherwise the suspicion of ignorance of this sharia has been glued to it. The source of the doctrine in the salaf is the Book and the Sunnah, and this doctrine is clears easy, innate and constant, which does not change with time, and is a middle ground between waste and over doing everything. Scholars and researchers should conduct more research to complete the aspects of the topic and investigate its issues with great effort for what this topic deserves and to clarify the legal concepts and provisions related to the subject in order to avoid intellectual deviation and corrupt interpretation. In order to enjoy the right thought and proper understanding of the texts and knowledge of the fundamental controls.
