المستخلص: البحث بصدد دراسة لعدد (5) وثائق سواحلية إبان الحكم العماني لزنجبار، سنوات (1925م، 1932م، 1939م) تصرفهم القانوني الرئيس هو طلب مبلغ من وكيل الأيتام لتجهيز عروس، وإشهار زواج، موضوع خاص بالتعامل مع رهن من خلال لجنة تحسين الديون ومفوض الديون بزنجبار، وطرق دفع الأقساط السنوية للمديونية من خلال لحنة ديون الرهن، وكشف حساب المديونية والمتبقي منه وعدد الأقساط، تمت في فترات زمانية وأماكن مختلفة من زنجبار، بها إشكاليات متمثلة في وجود اختلافات من حيث الصيغ القانونية والدبلوماتية لكل تصرف قانوني، وأخرى متعلقة بتحديد الأماكن الجغرافية بدقة، ووجود بعض مفردات الحياة والعملة، وعلاقة الدولة بالفرد ووجود مؤسسات اجتماعية خاصة بالأيتام، ولجنة جدولة الديون والرهون، وتسجيل عقود الزواج؛ لضمان حقوق الناس؛ لأنه مجتمع متعدد الجنسيات، وهؤلاء كثيري الترحال، ومن ثم هناك قواعد عامة اتبعت في كتابة مثل هذه الوثائق في تلك المنطقة الجغرافية من أفريقيا، وكيفية توثيقها وألفاظها وعباراتها المستخدمة، وأسماء البلدان المذكورة بالوثائق محل الدراسة، وقد اعتمد البحث على المنهج التاريخي التحليلي، وذلك من خلال مراجعة المصادر الأولية ونقدها نقداً خارجياً وداخلياً، بالإضافة للمراجع الثانوية واستخدام أدوات مثل: الملاحظة التحليلية الناقدة لتلك المصادر، بالإضافة لمقابلة شخصيات عمانية زنجبارية لتوضيح بعض الأمور في الترجمة من السواحلية إلى العربية، واستخدام المنهج الدبلوماتي للوصول إلى الصيغ والأجزاء القانونية بالوثائق.

Research in connection with a study of (5) Swahili documents during the Omani rule of Zanzibar, years (1925 AD, 1932 AD, 1939 AD), their main legal action is to request an amount from the orphan’s agent to equip a bride, and to declare a marriage, a topic related to dealing with a mortgage through the Debt Improvement Committee and the Debt Commissioner in Zanzibar And the methods of paying the annual installments of the debt through the mortgage debt bill, and the disclosure of the debt account, the remainder of it, and the number of installments, which took place in different periods of time and places in Zanzibar, with problems represented in the presence of differences in terms of legal and diplomatic formulas for each legal action, and others related to accurately determining geographical locations And the existence of some vocabulary of life and the currency, the relationship of the state to the individual and the existence of social institutions for orphans, the debts and mortgage scheduling committee, and the registration of marriage contracts; To guarantee people's rights; Because it is a multinational society, and these people are very mobile, and then there are general rules that were followed in writing such documents in that geographical region of Africa, how to document them, their used expressions and phrases, and the names of the countries mentioned in the documents under study, and the research relied on the historical and analytical method, and that is from During the review of primary sources and their critique of external and internal criticism, in addition to secondary references and the use of tools such as: critical analytical notes to those sources, in addition to interviewing Omani Zanzibari personalities to clarify some matters in translation from Swahili into Arabic, and using the documentary approach, to reach the legal formulas and parts of documents.
