المستخلص: كرس كل من الدستور الجزائري والمغربي حرية تكوين الأحزاب السياسية كما ورد ضمن الاتفاقيات الدولية المتعلقة بحماية حقوق الإنسان والتي تم المصادقة عليها من قبل الجزائر والمغرب، حيث اعتمد كل من قانون الأحزاب الجزائري والمغربي على نظام للتأسيس يحدد من خلاله شروط تأسيس الأحزاب السياسية وإجراءاتها كما كفلا ضمانات للتأسيس بغرض حماية الأعضاء المؤسسين من تعسف السلطة الإدارية وإهدار الحرية الحزبية.

Consacre tous de la constitution algérienne et la liberté marocaine de former des partis politiques ,selon ce qui a été indique dans les conventions internationales des droits de l homme ratifies par l’Algérie et le Maroc, ou les partis algériens et le droit marocain a adopte un système d’établissement identifie par la clause établissant les parties et procédures que politiques et garantie pour l’établissement du but de protéger souhaitant dans la formation d’un parti politique a l’arbitraire de l’autorité administrative.

Both the Algerian and Moroccan constitutions enshrined the freedom to form political parties as stated in the international conventions related to protecting human rights ratified by Algeria and Morocco. Both the Algerian and Moroccan political parties' law is dependent on a system of incorporation that defines the conditions and procedures for establishing political parties. It also guaranteed incorporation in order to protect the founding members from the abuse of the administrative authority and the waste of partisan freedom.
