المستخلص: Les contrats de concession relatifs au domaine public présentent un intérêt indéniable pour la valorisation domaine public foncier. Ils permettent le respect de l’affectation de ces biens à l’intérêt public, puisqu’ils obéissent aux règles de l’occupation privative du domaine public. En outre, le recours à ces contrats constitue une alternative au financement public des infrastructures. Ces contrats présentent en effet des garanties pour l’investissement privé, afin de construire un partenariat public privé .A la tête de ces garanties, il y a la reconnaissance au profit du concessionnaire d’un droit réel sur les ouvrages qu’il réalise sur le domaine public.

Concession contracts relating to the public domain are of undeniable interest for the valuation of public real estate. They allow the respect of the assignment of these goods to the public interest, since they obey the rules of private occupation of the public domain. In addition, the use of these contracts is an alternative to public financing of infrastructure. These contracts offer guarantees for private investment, in order to build a public-private partnership. At the head of these guarantees, there is the recognition for the benefit of the concessionaire of a real right over the works he carries out on the public domain.

إن عقود امتياز الأملاك العمومية تعتبر آلية في غاية الأهمية من أجل تثمين الأملاك العامة العقارية. ذلك أنها تكفل المحافظة على تخصيص هذه الأملاك لتحقيق المصلحة العامة لكونها لا تخرج عن خصائص الشغل الخاص للملكية العمومية. وهي تمثل فرصة هامة للإدارة لتمويل مشاريع البنية التحتية بالاعتماد على تمويل خاص بدل إنهاك التمويل العمومي. وهي أيضا تمنح ضمانات للمستثمرين من أجل الدخول في شراكة مع القطاع العام، وعلى رأس هذه الضمانات الاعتراف بحقوق عينية على المنشآت والتجهيزات التي يقوم صاحب الامتياز بإنجازها.
