المستخلص: Novel Corona virus Pandemic (COVID 19) is one of the largest pandemics that spread across the globe and its effects have been reflected in various levels: economic, social, political, health, security, etc. This research highlights the subject of: overcrowding on ventilators and treatment during Corona virus Pandemic as one of the implications and repercussions of this Pandemic on the doctor’s responsibility, the research explains the opinion of Islamic Law (Sharia) on the impact of necessity and need on the doctor’s responsibility during this health Pandemic and jurisprudential contemporary issue. The research discussed the jurisprudential ruling of the origin of issue and the responsibility of the doctor when patients crowded over medical resources during Corona virus Epidemic, while verifying the cause of necessity and need on the contemporary issue and discussing the jurisprudential ruling in the light of Islamic Law (Sharia) purposes. The study adopted the inductive approach of books of Islamic jurisprudence, principles, studies, and recent relevant articles to extract opinions on the jurisprudential ruling of the origin of the issue, to edit the cause of disagreement, to discuss the jurisprudential ruling in the light of Islamic Law (Sharia) purposes and to verify the cause of necessity and need on the issue. The research concluded to define the responsibilities of the doctor by stating the permissible cases of refraining from treatment with its controls, to set a number of criteria to give priority among patients if necessary, and to determine Islamic Law (Sharia) purposes achieved by this ruling under the governing circumstances.

تعد جائحة فيروس كورونا المستجد covid-19)) من أوسع الجوائح التي عمت المعمورة، وانعكست آثارها على مختلف الأصعدة؛ الاقتصادية والاجتماعية والسياسية والصحية والأمنية وغيرها. ويأتي هذا البحث ليسلط الضوء على موضوع التزاحم على أجهزة التنفس والعلاج في ظل وباء كورونا كأحد تداعياتها وانعكاساتها على مسؤولية الطبيب، فيوضح موقف الشرع من أثر الضرورة والحاجة في تلك المسألة في ظل هذه الجائحة الصحية والنازلة الفقهية. وقد قسمت البحث إلى تمهيد وثلاثة مباحث، تناولت في التمهيد مفردات العنوان بالإيضاح اللازم وعرضا لصورة النازلة، ثم شرعت في بيان أثر الضرورة والحاجة في التزاحم على أجهزة التنفس والعلاج في ظل وباء كورونا المستجد covid-19)) في ثلاثة مباحث، الأول في الحكم الفقهي لأصل المسألة، والثاني في مسؤولية الطبيب عند تزاحم المرضى على الموارد الطبية في ظل وباء كورونا، والثالث في تحقيق مناط الضرورة والحاجة في النازلة ومناقشة الحكم الفقهي على ضوء المقاصد الشرعية. وانتهى البحث إلى تحديد مسؤوليات الطبيب بتبيان حالات الامتناع عن المعالجة الجائزة، ووضع عدد من المعايير للترجيح بين المرضى إذا دعت الضرورة لذلك.
