المستخلص: Involving the private sector in the economic development process aims to reduce the burden on the state treasury. It also aims to improve the public service and is achieved mainly through contracts entered into by the state with the private sector. These contracts include what are described as “administrative contracts.” These contracts are constantly renewed and expanded steadily. They change in their form, content, and formulation, and thus the legal rules governing them change due to several factors, most importantly, the extent to which the state needs to conclude it in order to achieve its economic tendencies, on the one hand, and the strength of the national and foreign private sector, and the extent to which it maintains its terms and dictates, on the other.

يهدف إشراك القطاع الخاص في عملية التنمية الاقتصادية لتخفيف العبء عن خزينة الدولة، كما يهدف لتحسين الخدمة العمومية، ويتحقق أساسا عن طريق العقود التي تبرمها الدولة مع الخواص، ومنها ما توصف "بالعقود الإدارية"، وهذه العقود في تجدد مستمر واتساع مطرد، فهي تتغير في شكلها ومضمونها وصياغتها، وبالتالي تتغير القواعد القانونية التي تحكمها بالنظر لعدة عوامل، أهمها مدى حاجة الدولة لإبرامها تحقيقا لتوجهاتها الاقتصادية من جهة، ومدى قوة القطاع الخاص الوطني والأجنبي، ومدى تمسكه بشروطه وإملاءاته، من جهة ثانية.

La participation du secteur privé dans le processus de développement économique vise à alléger le fardeau sur le Trésor public ainsi qu’à accomplir et améliorer le service public. Elle est principalement réalisée par des contrats conclus par l'Etat avec les particuliers y compris ce qui est décrit comme «contrats administratifs». Ces contrats se renouvellent sans cesse et s'élargissent de façon constante en changent dans la forme, le contenu et la formulation. Par conséquent, compte tenu de plusieurs facteurs, les règles juridiques qui les régissent changent également notamment celles relatives au besoin de l'État pour conclure une enquête sur son orientation économique d'une part, l'étendue du secteur privé national et international, et l'ampleur de l'adhésion à ses conditions et exigences d’autre part.
