|a شهدت الإدارة العامة بفضل التقدم التكنولوجي الحديث تطوراً هائلاً، فقد أصبحت وسائل تواصلها مع العاملين فيها، والمتعاملين معها، والمنتفعين من خدماتها إلكترونيه، فلم يعد صاحب الشأن يذهب لمراجعة الإدارة شخصياً لاستصدار قرار أو طلب خدمة عامة من الخدمات التي تقدمها، بل يكتفي بأن يرسل لها طلباً إلكترونياً عبر موقعها الإلكتروني، بل أن العديد من الدوائر الحكومية تشترط أ، تقدم الطلبات إلكترونياً فلم تعد تقبل الورقية شكلاً. لا شك أن تقديم الطلبات الإلكترونية يثير العديد من الإشكاليات القانونية، فمنها ما يتعلق بشكل الطلب الإلكتروني، والمعلومات والبيانات التي يجب أن يتضمنها، والوثائق والمستندات التي ترفق به. ناهيك عن مواعيد تقديمها، وآلية إصدار القرارات الإدارية، وتبليغها إلى أصحاب الشأن. كما أن إصدار قرارات إدارية استناداً لمعلومات وبيانات غير صحيحة أو وثائق ومستندات مزورة أو غير صحيحة يؤدي إلى بطلان القرار الصادر، وجواز سحبه دون التقيد بميعاد معين، فلا يملك صاحب الشأن الاحتجاج بفكرة الحق المكتسب.

|b Increasing of technology using has changed the manner of delivering the public utilities services from a traditional method to an electronic way. Unlike the classical administration, the current electronic governments require to send the applications by the people over the websites and the administrative decisions must be also issued electronically. The process of sending the applications and issue the administrative decisions in an electronic way has raised some legal issues which this article will examine related to the form of electronic application, the provided information, the documents that must be attached, the deadline of submitting, and informing the concerned applicants. Issue administrative decisions according to wrong information or fake documents in this regard may also lead to the nullity of decision and the possibility of withdraw it at any time without the claim of gained rights.
