المستخلص: The special international criminal tribunals have presented a model that may not be the best but is the finest when compared to the Second World War Tribunals. The experience of international criminal tribunals has made it possible to give a strong impetus to international criminal law by defining the concept of the crime of sexual violence that has enriched war crimes and crimes against humanity.
The experience of the International Criminal Courts is a firm presumption of the possibility of an international criminal court that meets all the formal and objective specifications of its counterparts in national criminal systems and thus paved the way for the birth of the International Criminal Court. Moreover, it is a bright demonstration of the effective role of international criminal justice in achieving respect for human rights.

لقد قدمت المحاكم الجنائية الدولية الخاصة أنموذجا ليس الأحسن ولكنه الأرقى إذا ما قورن بمحاكم الحرب العالمية الثانية. لقد مكنت تجربة المحاكم الجنائية الدولية من إعطاء دفع قوي للقانون الدولي الجنائي عبر تحديد مفهوم جريمة العنف الجنسي ما أثرى جرائم الحرب والجرائم ضد الإنسانية.
إن تجربة المحاكم الجنائية الدولية هي قرينة قاطعة على إمكانية قيام محكمة جنائية دولية تتوفر على كل المواصفات الشكلية والموضوعية لقريناتها في الأنظمة الجنائية الوطنية وهي لذالك مهدت لولادة المحكمة الجنائية الدولية. وأكثر من ذالك برهان ساطع على الدور الفعال للعدالة الجنائية الدولية في تحقيق احترام لحقوق الإنسان.


Les tribunaux pénaux internationaux ont présenté une opportunité en or pour l’évolution du droit international pénal. La jurisprudence progressiste des TPI a apporté un apport significatif en matière des violences sexuelles par les précisions apportées a la définition du viol.
Ces avancées sont la preuve de la marche lente mais sure de la justice pénale internationale vers l’édification d’un ordre juridique internationale efficace et équitable ou Le respect des droits de l’homme, en tout temps est sa première préoccupation.
