المستخلص: Unlike some jurists and economists who consider that the notion of efficiency is different from the notion of fairness and fair distribution, recent economic and legal literature shows that there is no difference; if there is a difference, it lies in the definition of the concept of efficiency. In this paper, within the framework of the law of bankruptcy, we show these points of difference and we disclose the one that we consider as a fair or efficient distribution.

Contrairement à certains juristes et économistes qui considèrent que la notion d’efficience est différente de la notion d’équité et d’une distribution juste, la littérature récente économique et juridique montrent qu’elle n’existe pas de différence et que s’il y a une différence, elle réside dans la définition de la notion d’efficience. Dans cet article, à partir du droit de la faillite, nous montrons ces points de différence et nous dégageons celui que nous considérons comme une distribution juste ou efficiente.
