In this article, we deal with one of the most important chapters of jurisprudence, i.e., the chapter of legitimate politics, by stating the reality of this term and the difference between it and positioning politics then deal with the rules and origins of legitimate policy as the criterion that differentiates between it and others, by indicating its association with jurisprudence in general. We will then explain how legitimate politics is related to the two types of diligence: deductive and applicable - Tahqeeq al-Manat (applying a general rule to an individual case)- given that legitimate politics is one of the chapters of Islamic jurisprudence. This abstract translated by Dar AlMandumah Inc. 2021 نتعرض في هذا المقال إلى باب من أهم الأبواب الفقهية، وهو باب السياسة الشرعية، وذلك ببيان حقيقة هذا المصطلح والفرق بينه وبين السياسة الوضعية، ثم التعرض لقواعد وأصول السياسة الشرعية باعتبارها المعيار الفارق بينها وبين غيرها وذلك من خلال بيان ارتباطها بالفقه عموما، ثم بيان كيفية ارتباط السياسة الشرعية بالاجتهاد بنوعيه: الاستنباطي والتنزيلي -تحقيق المناط -وذلك باعتبار أن السياسة الشرعية باب من أبواب الفقه الإسلامي. Nous présentons dans cet article la porte de la jurisprudence la porte de la politique légitime, en montrant la vérité de ce terme et la différence avec le positivisme politique, puis l'exposition aux règles et principes de la politique de légitimité comme critère de la différence avec la jurisprudence en général.
