المستخلص: هدفت الدراسة إلى التعرف على الاستنباط الفقهي مفهومه وضوابطه، وأشارت الدراسة إلى أن الاستنباط يتحقق من خلال التعمق في النصوص الشرعية، والفهم الخاص للناظر فيها، حيث تختلف النظرات حسب اهتمام الناظر وفكره وتخصصه. وركزت الدراسة على أربعة محاور وهي، أوضح المحور الأول الفرق بين الاستنباط والتفسير، وتناول المحور الثاني طريق استنباط الأحكام من القواعد الأصولية، وناقش المحور الثالث الاستنباط السديد، وشرح المحور الرابع الاستنباط العليل.
واختتمت الدراسة بأن الاستنباط الفقهي يستلزم من الفقيه وطالب الاستنباط معرفة طريق الاستنباط وإدراك القواعد الأصولية والفقهية، وتحصيل كل ما يدخل في دلالة التقعيد، وذلك بأن يكون خبيرًا بمناهج تركيب القاعدة وصياغتها وأساليبها، مدركًا لحقيقة القاعدة وضوابطها وعناصر تكونها وطرق إيجادها، كما يتطلب منه أن يكون عالمًا بمقاصد الشريعة وأصولها، وكذلك بفقه الفروع والجزئيات، حاذقًا بمنهج الاستنباط وطرق استخراج الأحكام الشرعية من مصادرها حتى يكون استنباطه صحيحًا.

The study aimed to identify the concept and controls of the jurisprudential derivation. The study pointed out that the development is achieved through the depth of the texts of legitimacy, and the special understanding of the reader, where the views vary according to the interest, idea and specialization of the reader. The study focused on four topics. The first topic explained the difference between the derivation and the interpretation. The second topic dealt with the method of deriving judgments from the fundamentalist rules. The third topic discussed the strict derivation. The fourth topic explain the problem of formation.
The study concluded that the jurisprudential derivation requires the jurists and the person who ask for the derivation to know its way, realize the fundamental and jurisprudential rules, and collect everything that is contained in the significance of setting rules. Therefore, he must be an expert in the structure and formulation and methods of the rule, as well as being aware of the truth and controls of the rule, the elements of their formation, and the ways to find it. It also requires him to be aware of the purposes of the Shari'a and its origins, as well as the jurisprudence of the branches and the parts, and being clever in the method of derivation and methods of deriving the shar'ia rulings from their sources so that his derivation is correct..
