المستخلص: This study attempts to stop abusive dominance as a restrictive practice for competition, provided for in Article 7 of Competition Ordinance 03-03 by clarifying the concept of economic aid concerned with practice, the concept of hegemonic status, as well as the conditions for the prohibition of arbitrary acts resulting therefrom, which we direct when economic aid carries out actions that hinder the normal course of economic activity in the market and the classification of these acts, we thus concluded that not all arbitrary acts are prohibited.

La présente étude vise à observer l’abus d’une position dominante comme pratique restrictive de concurrence tel que prévu à l’article 07 de l’ordonnance n°03- 03 relative à la concurrence, en déterminant la notion de l’agent économique concerné par la pratique, la notion de la position dominante ainsi que les conditions de la prohibition des actes abusifs y résultants, auxquels on fait face lorsque l’agent économique accomplit des actes entravant le processus normal de l’activité économique dans le marché et de classifier ces actes, pour conclure enfin que les actes abusifs ne sont pas tous prohibés.

تحاول هذه الدراسة أن تقف عند التعسف في وضعية الهيمنة كممارسة مقيدة للمنافسة، نصت عليها المادة 07 من الأمر 03-03 المتعلق بالمنافسة، وذلك من خلال تبيان مفهوم العون الاقتصادي المعني بالممارسة، ومفهوم وضعية الهيمنة، وكذا شروط الحظر على التصرفات التعسفية الناتجة عنها، والتي نوجهها حينما يقوم العون الاقتصادي بأعمال تؤدي لإعاقة المسار الطبيعي للنشاط الاقتصادي في السوق، وتصنيف هذه الأعمال، لنخلص إلى أنه ليست كل التصرفات التعسفية محظورة.
