إن الشريعة الإسلامية بما تتصف به من العالمية والشمول والمرونة، ما جاءت إلا لتحقيق سعادة البشر في معاشهم ومعادهم. ففقه النوازل من أدق مسالك الفقه وأهمها، حيث إن المجتهد فيها يطرق موضوعات لم تطرق من قبل ولم يرد فيها عن السلف قول، بل هي قضايا مستجدة يغلب على معظمها طابع العصر الحديث المتميز بابتكار حلول علمية لمشكلات متنوعة وحديثة واستحداث وسائل لم تكن تخطر ببال البشر يوما. ويتمثل الهدف من هذا البحث معرفة معايير وضوابط الاجتهاد في النوازل المستجدة عند الأصوليين، وتبدو أهميتها في التأكيد على صلاحية الشريعة لكل زمان ومكان واستيعابها لكل حادث ومستجد. وتتمثل مشكلة الدراسة في أن نصوص الشريعة متناهية ومحدودة لا تقبل الإضافة ولا التغيير، والحوادث والنوازل التي تنزل بالناس لا نهاية لها، كل ذلك يجعل الاجتهاد مشروعا حتى تتحقق الأهداف التي ترمي إليها الشريعة من جلب المصالح ودرء المفاسد والتيسير ورفع الحرج. اعتمدت الدراسة على المنهج الاستقرائي التحليلي بالرجوع إلى أمهات كتب أصول الفقه والحديث واللغة والمراجع الحديثة لتوفير المادة العلمية المتعلقة بالموضوع. وخلصت الدراسة إلى عدة نتائج منها: يجب التأكد من وقوع النازلة قبل الحكم فيها ودراستها مستوفية، وفهم النازلة فهماً دقيقا شاملا لكل جوانبها مع مراعاة أحكام النوازل ومعايير وضوابط الاجتهاد فيما، لا سيما في عصرنا الحالي.
The Islamic Sharia, with its universality, comprehensiveness and flexibility, came only to achieve the happiness of human beings in their livelihood and afterlife. The jurisprudence of calamities is one of the most accurate and important paths of jurisprudence, as the mujtahid deals with topics that were not previously mentioned and there was no saying about the predecessors. Rather, they are emerging issues, most of which are characterized by the character of the modern era characterized by the creation of scientific solutions to various and modern problems and the development of methods that were never thought to humans. . The problem of the study is that the texts of Sharia are finite and limited and do not accept addition or change, and the accidents and calamities that befall people are endless, all of this makes Ijtihad legitimate until the goals that the Sharia aims to bring about, to bring interests, ward off evil, facilitate and remove embarrassment. The study relied on the analytical inductive approach by referring to the mothers of the books of fundamentals of jurisprudence, hadith, language and modern references to provide the scientific material related to the topic. The study concluded with several results, including: The occurrence of the calamity must be ascertained before judging it and studying it in a complete study, and an accurate and comprehensive understanding of all aspects of the calamity must be taken into account. Rulings of calamities, standards and controls of ijtihad, especially in our current age.
