|a يعتبر موضوع التعويض المستحق في حال تأخر المدين في تنفيذ التزاماته وخاصة في الظروف القاهرة باعتباره يمثل أحد حالات استحقاق التعويض في إطار المسؤولية العقدية وهو من أهم المواضيع لأن دراستها تم تقسيمها بين أحكام القانون المدني المقارن وأحكام الفقه الإسلامي حيث قسم هذا النوع من التعويض إلى تعويض عن تأخر المدين في تنفيذ التزامه وهو القيام بعمل أو الامتناع عن عمل والنوع الثاني وهو التعويض المستحق بمبلغ من النقود وهو ما اصطلح على تسميته بالفائدة القانونية وقد بحثت كل ما يتعلق بهذا الموضوع في هذا البحث.

|b The subject of the compensation due in the event of the debtor’s delay in fulfilling his obligations, especially in force majeure, is considered one of the cases of compensation entitlement within the framework of contractual liability, and it is one of the most important topics because its study was divided between the provisions of the comparative civil law and the provisions of Islamic jurisprudence, where this type of compensation was divided into compensation for Delay by the debtor in carrying out his obligation, which is to do an act or abstain from work, and the second type is compensation due with an amount of money, which has been termed as legal interest, and everything related to this topic has been discussed in this research.
