المستخلص: الهدف من البحث: هو بيان صور التميز والإبداع في التعامل مع السياح وأثره على الارتقاء بصناعة السياحة، التي تعد هدفا من أهداف التنمية المستدامة، وبيان ضوابط التعامل مع السائح من منظور إسلامي؛ ليتحقق مقصد الشرع في نشر الإسلام. هذا إذا كان السائح مسلما، فإن كان غير مسلم، فإن التعامل معه يحتاج إلى فقه رشيد يحافظ على التوازن والاعتدال في المعاملة، حتى لا تجنح إلى الغلظة والشدة والجفاء دون مسوغ لذلك، أو تجنح إلى التساهل وتمييع الأحكام دون مسوغ لذلك. منهج البحث: نهجت في هذا البحث المنهج الاستقرائي والمنهج المقارن، باستقراء المسائل المتعلقة بالسائح في كتب الفقه القديمة والمعاصرة وربط ما ذكره الفقهاء في كتب التراث الفقهي، بما وضعه الاقتصاديون في التخطيط السياحي في كيفية التعامل مع السائح. واستخدمت المنهج المقارن في مقارنة المسألة الفقهية بين المذاهب الفقهية، وبيان أوجه الاتفاق والاختلاف بينهم. النتائج: كان للشريعة الإسلامية فضل السبق في بيان كيفية التعامل مع السائح فقد حرصت على التسامح في التعامل معه، والرفق به، والمحافظة على أمنه وأمانه، وإيصاله آمناً إلى بلده، وكفلت له حرية العقيدة والعبادة، وأوصت بحسن مجاورته، وعاقبت من يتعدى عليه. والسائح أيضا بحاجة لعملية البيع والشراء، سواء أكانت لمواد تموينية يقتات بها، أم ملابس أم لغيرها، وكذلك فهو بحاجة للإجارة، والوكالة، والوديعة وقبول الهدايا والإهداء للآخرين، وجميع المعاملات المتداولة اليومية التي لا غنى عنها؟ وقد أباحت الشريعة الإسلامية التعامل معه في المعاملات الشرعية، ولذلك نحن بحاجة لبيان الضوابط الشرعية لتوعية من يتعامل معه أن يكون حريصا على أمانته وعدم استغلاله، وخاصة في العقود الإلكترونية، ليتحقق الأمن التعاقدي. التوصيات: ضرورة نشر ثقافة التعامل مع السائح وبيان عظمة الشريعة الإسلامية في هذا الجانب، وتخصيص دورات في مهارات التعامل مع السائح على أن يحضر هذه الدورات العاملين في مجال السياحة.

The aim of the research: is to show the images of excel¬lence and creativity in dealing with tourists and its impact on up¬grading the tourism industry, which is a goal of sustainable devel¬opment, and to explain the controls of dealing with tourists from an Islamic perspective, so that the purpose of Sharia in spread¬ing Islam is achieved. This is if the tourist is a Muslim, if he is not Muslim, then deal¬ing with him needs a responsible jurisprudence that maintains balance and moderation in treatment, so that it does not tend to be rude, intense and dull without justification for that, or it tends to be lenient and dilute judgments without justification for that. Research methodology: In this research, I used the induc¬tive and comparative approach, by extrapolating issues related to tourists in the books of ancient and contemporary jurisprudence and linking what the scholars mentioned in the books of juristic heritage, including what economics put in tourism planning in how to deal with the tourist. The comparative method was used to compare the doctrinal issue between doctrinal doctrines, and to clarify aspects of agreement and the difference between them. The results: Islamic law had the preference in explaining how to deal with the tourist, as it was keen to tolerate dealing with it, to be comfortable with it, to maintain its security and safety, and to deliver it safely to its country, and it guaranteed freedom of belief and worship, and recommended good neighborliness, and punished those who transgressed it. And the tourist also needs the process of buying and selling, whether it is catering supplies, food, or other things, as well as he needs rent, agency, deposit, accepting gifts and gifting to others, and all the daily trades that are indispensable? Islamic law has permitted it to be dealt with in Sharia transactions, and for this we need to outline Sharia controls to educate those who deal with him to be keen on his honesty and not using it, especially in electronic contracts, to achieve contractual security. Recommendations: The necessity of spreading the culture of dealing with tourists and explaining the greatness of Islamic law in this regard, and allocating courses in the skills of dealing with tourists, provided that those courses attended by workers in the field of tourism are attended.
