لقد فرض واقع البيئة الرقمية ظاهرة النسخ الخاص للمصنفات وتبادلها؛ لذلك أصبح لزاما إعادة النظر في كثير من القواعد الناظمة لعملية النسخ الخاص، فممارسة قيد النسخة الخاصة في البيئة الرقمية يختلف بالتأكيد عن ممارسته بالنسبة للمصنفات المنشورة بالطرق التقليدية. فالتقدم التكنولوجي بكافة صوره وأشكاله، أدى إلى سهولة ممارسة قيد النسخة الخاصة، واستتبع ذلك سهولة تداول المصنفات واستغلالها بصورة تمثل خطرا على حقوق المؤلف في مصنفاته. وفي ضوء التحديات التي أضحت واقعا ملموسا وتحت تأثير البيئة الرقمية على ممارسة قيد النسخة الخاصة بالرغم من إقرار المشرع لتدابير الحماية التكنولوجية، فقد أصبحت النسخة الخاصة تمارس من قبل العديد من الباحثين إلى أن كادت أن تصبح قاعدة عامة في تداول المصنفات، لا مجرد قيد على الحق الأصلي في ظل وجود نصوص قانونية قد تحد من هذا القيد إلى درجة المنع. ومن خلال هذه الدراسة سنلقي الضوء على النصوص الناظمة لقيد النسخة الخاصة في التشريع الإماراتي، وبيان أنها إذا كانت محققة للتوازن المطلوب بين حق المؤلف في حماية إنتاجه الفكري ومصلحة المجتمع من كون النسخة الخاصة قد ترتقي بمستوى الأفراد في المجتمع، وتعمل على زيادة وعيهم وثقافتهم.
The reality of the digital environment has imposed the phenomenon of private copying of works and their exchange, which has made it necessary to review many of the rules governing the process of private reproduction. Practicing the special version in the digital environment is certainly different from its practice for works published in the traditional ways. The technological progress, in all its forms, has led to ease practicing the private version of the author’s works and exploiting them in a way that forms a danger on the author’s copyrights. In the light of the challenges that have become tangible and under the influence of the digital environment on the practice of the private version, despite of the legislator's approval of technological protection measures, the private version has been practiced by many researchers until it almost became a general rule in the circulation of works and not merely a restriction on the original while there are certain legal texts that may limit this constraint to the extent of prevention. In this study, we will shed light on the provisions governing the special version in UAE legislation and a statement on whether it achieves the desired balance between the author’s right to protect his/her intellectual production and the interest of society since the private version may raise the level of individuals in society and increase their awareness and culture.
