المستخلص: من المبادئ المستقرة قانونا أنه إذا بطل الأصل بطل الفرع، وإذا بطل العقد يبطل مضمونه وتفاصيله وشروطه، لكن هل ينطبق هذا الأمر على العقد المتضمن لشرط التحكيم، فيبطل اتفاق التحكيم تبعا لبطلان العقد الأصلي المتضمن لشرط التحكيم؟. والحقيقة أن العديد من الأنظمة القانونية قد سارت ولازال بعضها يسير على ذلك النهج القانوني التقليدي، إلا أن الفقه والتشريع والقضاء المقارن قد عدل عن هذا التوجه إلى نقيضه تماما، وتجسد ذلك في مبدأ استقلال شرط التحكيم، ولا شك أن العديد من تشريعات التحكيم المقارنة تبنت صراحة هذا المبدأ، بما يترتب عليه من نتائج وآثار مختلفة، ومراكز قانونية جديدة بهذا الخصوص، وعلى رأسها إعمال مبدأ الاختصاص بالاختصاص. وقد سار في ركب تلك الأنظمة الحديثة التي سلكت هذا النهج الجديد، النظام القانوني الفلسطيني، والسواد الأعظم من التشريعات الوطنية والدولية وأنظمة هيئات ومراكز التحكيم الدائمة.

One of the legally established principles is that if the original invalidated the branch, and if the contract is nullified, its content, details and terms are nullified, but does this matter apply to the contract containing the arbitration clause, then the arbitration agreement is invalidated according to the nullity of the original contract containing the arbitration clause? The truth is that many legal systems have followed and some of them still follow that traditional legal approach. However, jurisprudence, legislation and comparative judiciary have changed this approach to its opposite completely, and this is embodied in the principle of independence of the arbitration clause. There is no doubt that many comparative arbitration legislations have explicitly adopted this principle, with its various consequences and effects, and new legal centers in this regard, chief among them the implementation of the principle of jurisdiction over jurisdiction. The Palestinian legal system, the vast majority of national and international legislation, and the systems of permanent arbitration bodies and centers, followed those modern systems that followed this new approach.
