المستخلص: لقد سطر الإمام أبو المظفر السمعاني رحمه الله تعالى معالم واضحة في التحرير الأصولي، منطلقا من حقيقة الوظيفة الأصولية، فينطلق من تحرير علم أصول الفقه مما علق به من تطويل ذيل الخلاف والدخيل الكلامي والفقهي والمثل الافتراضية، وكذلك من تبعات القضايا المتعلقة بعلم الكلام، والتي دارت رحى الخلاف فيها في علم الأصول امتدادا للآراء الكلامية المثارة من قطبي المدارس الكلامية؛ المعتزلة والأشاعرة. كل هذا ليحقق وظيفة علم الأصول وهي العودة بفائدة فقهية استنباطية، على سنن الفقهاء لا سنن المتكلمين، ولا الجدليين، وهذا يجلي لنا إشكالية البحث وهي عدم الاهتمام الكافي بإبراز معالم فكر الإمام السمعاني في التحرير الأصولي، فقد ظهر في هذا الدراسة من براعة الإمام أبي المظفر السمعاني رحمه الله تعالى في التحرير الأصولي دقته في التعامل مع الخلاف الأصولي وتحرير محل الوفاق ومحل الخلاف، والرد والتعقب، وقد جاء كل ذلك ضمن الإطار المنهجي لعلم أصول الفقه، فهو ينبه مرة بعد أخرى، ويرسخ فكرة تحرير المادة الأصولية من المادة الدخيلة عليها. لذا، فإن تركيز هذه الدراسة محاولة الإجابة عن عدة سؤالات وكان منها ما حقيقة الوظيفة الأصولية عند الإمام السمعاني، وأثر تحرير الوظيفة الأصولية في اختياراته رحمه لله وكذلك التأكيد على أبرز معالم التحرير الأصولي، ومن ذلك حصر المذاهب، والتحقق من نسبة هذه المذاهب إلى أصحابها، وحصر محال الوفاق ومحل النزاع، وغير ذلك، وقد ظهرت نتائج ذلك وانعكاساته على تفريعاته، وفي مواقفه من الأمثلة الافتراضية والخلاف، وتركيزه على أن يعود علم الأصول بفائدة في الفهم أو الاستنباط.

Abo al-Muzaffar al-Samani set clear features for the fundamentalist editing starting by the fundamentalist role truth. He started to clear the (Usul Al-Fiqh) Principles of Islamic Jurisprudence from prolonging the of jurisprudence utterances, extraneous to the knowledge of to the science of Usul (fundamental of religion) and the artificial examples. As well as the consequences of cases related to theology, in which the controversy revolved around the science of origins as an extension of The scholastic opinion raised by the trends of schoistic schools. Mu'tazila and Ash'ari. all this to achieve the function of the (Usul Al-Fiqh) Principles of Islamic Jurisprudence which to come up with in Jurisprudence benefit according to the method of the jurists, not scholars of Scholastic theology and the debaters. This shows us the problem of the research, which is the lack of sufficient attention to highlighting the features of Abi al-Muzaffar al-Samani for the fundamentalist editing. In this study, His crafty in the fundamentalist editing and his accuracy in handling the fundamentalist debate and editing what have agreed and disputed on in addition to the refuting and tracing them. All this comes within the systematic framework of Usul Al-Fiqh. He always support and consolidate the idea of filtering the Usul Al-Fiqh from the extraneous articles. Therefore, The focus of this study is an attempt to answer several questions, including on the fundamentalist role truth of Abi al-Muzaffar al-Samaani, And the effect of liberalizing the fundamentalist position on his choices, As well as emphasizing the most prominent features of the fundamentalist liberation, such as enumerating the doctrines, verifying their attribution to their owners, and limiting the places of reconciliation and the place of discussion, and others. The results of this and their repercussions have appeared on its branches, in its position on hypothetical examples, and dispute. and its focus on making Usul Al-Fiqh useful in understanding or analysis.
