|a يعتبر الضبط الإداري من المواضيع المهمة في القانون، لذلك تحرص دساتير وتشريعات الدول على منح السلطة الإدارية الاختصاص بإصدار قرارات الضبط الإداري لحماية النظام العام. ولما كانت الدولة مجسدة في السلطة التنفيذية، فإنها لا تترك للأفراد المجال المفتوح لممارسة نشاطهم بحرية، بل تفرض عليهم نوع من الرقابة لحماية النظام من أنشطتهم التي قد تهدد النظام العام وهو ما يعرف بالضبط الإداري. وتفاديا لتداخل الاختصاص في ممارسة هذه الوظيفة الإدارية، تحرص غالبية الدول على أن تتضمن تشريعاتها تعيين الجهات والهيئات تحديدا دقيقا، يخول لها القيام بأعمال الضبط الإداري بكافة أنواعه سواء كان قضائيا أو إداريا. وفي الجزائر تحديدا، تتنوع سلطات الضبط الإداري على درجتين، الأولى على المستوى الوطني والمتمثلة في سلطات الضبط الإداري المركزي والأخرى متواجدة على مستوى الجماعات الإقليمية والمتمثلة في سلطات الضبط الإداري المحلي، إلا أن ممارسة هذا النوع من الوظيفة يخضع لضوابط، لأن ممارستها بحرية يترتب عنها مساس بالحقوق وإهدار لحريات الأفراد، لذلك، يجب أن توضع قيودا على الهيئات الممارسة للضبط الإداري كانت مركزية أم محلية من خلال تحديد الضوابط التي يجب على هذه الهيئات أن تلتزم بها لحماية النظام العام وحريات الأفراد.

|b Administrative control is considered as an important topic in law. Therefore, the constitutions and legislation of countries are keen to grant the administrative authority the jurisdiction to issue administrative control decisions to protect public order. And since the state is embodied in the executive authority, it does not leave them an open space to freely exercise their activities. Rather, it imposes a kind of oversight on them to protect the system from the activities of individuals that may threaten the public order, which is what is known exactly as the administrative control. And in order to avoid overlapping jurisdiction in the exercise of this administrative function, most countries are keen to ensure that their legislation includes precise identification of entities and bodies, empowering them to carry out administrative control work of all kinds, whether judicial or administrative. And in Algeria specifically, the administrative control authorities vary over two degrees. The first is at the national level represented in the central administrative control authorities, and the other is present at the level of regional groups and represented by the local administrative control authorities. However, exercising this type of function is subject to controls, because its practice with freedom will result in a violation of the rights and waste of the individuals’ freedoms. Therefore, restrictions must be placed on the bodies that practice administrative control, whether central or local, by defining the controls that these bodies must adhere to protect public order and the freedoms of individuals.
