|a يعد مرض التوحد من الأمراض الغريبة، وغرابة المرض التوحدي تتمثل في عدم معرفة أسبابه وطرق علاجه، إلا أن التوحدي يضل ذلك الإنسان الذي بحاجة للحماية، والقانون كفيل بتوفير هذه الحماية سواء على المستوى الدولي أو المستوى الداخلي. إن دراسة أحكام أهلية التوحدي لها من الأهمية وذلك باعتبار الأهلية من شروط صحة التصرفات القانونية، والتي يشترط فيها الإدراك والتمييز، والتوحدي له من الاضطرابات العصبية التي قد تفقده العقل فيكون عديم الأهلية أو تنقص من قدراته فتجعل منه ناقصا للأهلية. فالتوحدي مريض مرضاً يؤثر على عقله مما يستدعي حمايته حماية قانونية سواء في إطار ممارسة حقوقه أو في حياته الاجتماعية وذلك بتقديم له من الحقوق التي تتماشى مع وضعه.
