المستخلص: عنوان البحث: اختيارات الإمام ابن الجوزي الفقهية في ولاية النكاح من خلال كتابه: التحقيق في أحاديث الخلاف "دراسة فقهية مقارنة. أما مشكلة البحث فهي: فقه الولاية في النكاح وحاجته إلى مزيد عناية ودراسة، ومنهج الإمام ابن الجوزي الفقهي الذي لم يلق عناية كبيرة من الباحثين، وكتابه "التحقيق" والذي لم يتعرض له الباحثون بالدراسة؛ لذا كانت أسئلة البحث كما يلي: ما أهم آراء ابن الجوزي في ولاية النكاح؟ وإلى أي حد يمكن اعتباره فقيها؟ وما جهوده في إثراء الفقه الاسلامي؟ وجاء الجواب في أهداف البحث وهي: استعراض آراء ابن الجوزي الفقهية في مسائل ولاية النكاح، وإبراز جهوده في الفقه الاسلامي. وتكمن أهمية البحث في التعرف على الجانب الفقهي في شخصية الإمام ابن الجوزي، وجمع اختياراته في ولاية النكاح. وقد سلك الباحث في هذا البحث المنهج الاستقرائي الوصفي التحليلي المقارن، وكذلك المنهج الاستنباطي التحليلي لآراء ابن الجوزي، بحيث تم استقراء المسائل المتعلقة بولاية النكاح في كتابه: "التحقيق في أحاديث الخلاف." وقد جاء البحث في مقدمة، وتمهيد، ومبحث، وخاتمة، وفهرس، ومن أهم نتائج البحث: اعتبار الإمام ابن الجوزي من أئمة المذهب الحنبلي المعتبرين، وله آراؤه الفقهية المعتمدة في المذهب، وهو في معظم الأحوال يسير وفق مذهبه الحنبلي ولا يخرج عنه إلا قليلا، واستطاع أن يقدم منظومة فقهية في كتابه "التحقيق في أحاديث الخلاف". وأهم توصيات البحث: الاهتمام بدراسة تراثنا الفقهي العظيم، وإبرازه، وتقديمه للناس بصورة عصرية لائقة، والاهتمام بكتب الإمام ابن الجوزي وشرحها وتنقيحها وبخاصة في جانب الفقه، وذلك بإقبال طلاب العلم ومتخصصي الفقه والشريعة من الباحثون والدارسين على هذه الكتب ودراستها والاعتناء بها.

Title: Choices of Imam Ibn al-Jawzi jurisprudence in the state of marriage through his book: "Investigation in the conversations of controversy" comparative doctrinal study. The problem of research is: the jurisprudence of the state in marriage and the need for more attention and study, and the approach of Imam Ibn al-Jawzi jurisprudence, which did not receive much attention from researchers, and his book, "Investigation", which researchers have not been exposed to the study. So the research questions were as follows: What are the most important views of Ibn al-Jawzi in the state of marriage? To what extent can he be considered a jurist? What are his efforts in enriching Islamic jurisprudence? The answer came in the objectives of the research, namely: review the views of Ibn al-Jawzi jurisprudence in matters of the mandate of marriage, and highlight his efforts in Islamic jurisprudence. The importance of research is to identify the jurisprudential aspect in the character of Imam Ibn al-Jawzi, and to collect his choices in the state of marriage. In this research, the researcher used a descriptive analytical and comparative inductive approach, as well as an analytical deductive approach to Ibn al-Jawzi's views. The research came in the introduction, and a prelude, and research, and conclusion, and index, and the most important results of the research: Imam Ibn al-Jawzi considered imams Hanbali considered, and has his jurisprudential views adopted in the doctrine, which is in most cases walking according to the Hanbali doctrine and come out only a little, He was able to present a system of jurisprudence in his book to investigate the conversations of the dispute. The most important recommendations of the research: interest in the study of our great jurisprudential heritage, highlighting, and presenting it to people in a decent modern way, and attention to the books of Imam Ibn al-Jawzi, explain and revise, especially in the field of jurisprudence, and the acceptance of science students and specialists of jurisprudence and Sharia researchers and scholars to these books and study and take care of them
