|a أدى التوسع في عرض المنتوجات في ظل ارتفاع موجة الترويجات عبر وسائل الإعلام والاتصال المحيطة بالمستهلك الإلكتروني إلى خلق هوة بينه وبين المورد الإلكتروني أين يكتفي المستهلك الإلكتروني برؤية الصور المعروضة على الشبكة دون أن يكون فكرة كاملة عن المنتوج ليكتشف فيما بعد انه تسرع في إبرام العقد الإلكتروني فلا مجال إذن للرجوع إلى الوراء لأنه ملزم بتنفيذ التزاماته العقدية طبقا للمادة 106 قانون مدني، فخروجا عن تلك القاعدة و أمام القصور في حماية المستهلك لم تجد تشريعات الاستهلاك سبيلا سوى بإقرارها لحق الرجوع ، لا سيما المشرع الجزائري الذي أقره من خلال القانون 18-05 حيث لم يتبناه بشكل شامل على الرغم من جملة التعديلات التي شملت قوانين حماية المستهلك بهدف الوصول إلى تحقيق النظام العام الاقتصادي.
