المستخلص: والذي تحت عنوان التدابير الوقائية لحماية المجتمع من الأمراض المعدية "دراسة فقهية" والمقدم من الباحث/ عمر محمود عبد المجيد أبو السعود وقد جاء هذا البحث في مقدمة وتمهيد وثلاثة مباحث وخاتمة. أما المقدمة فاشتملت على: الافتتاح والإعلان عن الموضوع، وأهميته وأسباب اختياره، والدراسات السابقة، ومنهج البحث، وخطة البحث. المبحث التمهيدي، وتضمن التعريف بمفردات البحث، واشتمل على مطلبين. المطلب الأول: مفهوم التدابير الوقائية. المطلب الثاني: مفهوم المرض المعدي. المبحث الأول: معاقبة المتسبب في نقل العدوى، واشتمل على مطلبين. المطلب الأول: الحكم الشرعي في تعمد نقل العدوى، واشتمل على فرعين. الفرع الأول: الحكم الشرعي في تعمد نقل العدوى للمجتمع بأثره. الفرع الثاني: الحكم الشرعي في تعمد نقل الدوى لأشخاص بعينهم. المطلب الثاني: الحكم الشرعي في نقل العدوى عن طريق الخطأ. المبحث الثاني: التدابير الوقائية لمنع انتشار المرض المعدي، واشتمل على خمسة مطالب. المطلب الأول: الحجر الصحي على المريض بمرض معد. المطلب الثاني: منع المريض بمرض معد من صلاة الجمعة والجماعة. المطلب الثالث: منع المريض بمرض معد من أداء الحج، واشتمل على فرعين.

The idea of this research is based on the study of preventive measures that can be taken to protect society from infectious diseases. This research came in a preliminary section in which it dealt with what is meant by preventive measures, as well as a statement of what is meant by infection and infectious disease. The preliminary section was followed by three sections, the first of which dealt with the punishment of the person responsible for transmitting the infection with a statement of the ruling for its deliberate transmission, or transmission by mistake. Then, in the second section, it dealt with the preventive measures that must be followed to avoid infection with the infectious disease where it dealt with the statement of what is meant by quarantining a patient with a contagious disease and a statement of his ruling, as well as the ruling on preventing a patient with a contagious disease from attending both Friday and congregational prayers. Then it explained the ruling on the pilgrimage (Hajj) of the patient with an infectious disease, along with the ruling on delegating him to someone else. In addition to the ruling on preventing the patient with a contagious disease from working, as well as preventing him from joining the educational institutes. In the third section, I dealt with an explanation of how to wash the patient with a contagious disease with an explanation of the Islamic ruling. Moreover, all of this by comparing the sayings of the scholars, their evidence, and the weighting between them. Finally, I concluded the research with a set of results and recommendations that emerged from this study research.
