المستخلص: يهدف هذا البحث للجواب على سؤالين مهمين: الأول ما هي مجالات اشتغال الحداثي في علم المقاصد؟، والثاني: كيف نحكم على هذا الاشتغال من ناحية علمية، ولذلك انتهج البحث خطة مقسمة على مبحثين بعد المقدمة: المبحث الأول نظري يتحدث عن تفكيك عناصر عنوان المداخلة ويتحدث عن السنة والمقاصد والحداثة ضمن ثلاثة مطالب، أولها مفهوم السنة النبوية وحجيتها وأقسامها، وأما الثاني فيتحدث عن علم المقاصد ونشأته وأهميته في منظومة العلوم الإسلامية، في حين أن المطلب الثالث فتضمن تعريف الحداثة ونشأتها وعلاقتها بالتراث والوحي. وأما المبحث الثاني فكان عن التوظيف الحداثي لعلم المقاصد في نقد السنة النبوية، من خلال تمهيد يتحدث عن مجالات اشتغال الحداثي بالمقاصد، ثم مطلب أول يوضح توظيف الحداثي لمفهوم المصلحة في محاكمة السنة، ومطلب ثان يبين توظيفه لمفهوم التصرفات النبوية للحد من شمول السنة وعمومها، ومطلب ثالث يبين مركزية العقل كأداة إجرائية في نقد السنة عند الحداثي. وكانت الخاتمة في نقد هذه الممارسة وبيان ما أضافته للمعرفة الدينية وقيمة هذه الإضافة وإمكانية الاستفادة منها في الحياة الدينية.

This research aims to answer two important questions: First, what are the areas that modernists work on concerning the science of purposes? The second question is how to judge this interest from a scientific point of view? Therefore, the research adopted a plan divided into two themes after the introduction: the first theme is theoretical that talks about the dismantling of the intervention title elements. It also talks about Sunnah, purposes and modernity within three divisions. The first one tackles the concept of the Prophet's Sunnah, its arguments and its sections. The second one talks about the science of purposes, its origins and its importance in the Islamic science system, while the third one included the definition of modernity, its origin and its relationship to heritage and revelation. The second theme tackled the modern application of the science of purposes in the criticism of the Prophet's Sunnah through a preface that talks about the modernist areas of interest in purposes. The first part explains the modernist use of the concept of interest in the Sunnah trial, and the second part shows his use of the concept “prophetic behaviors” to reduce the inclusiveness of Sunnah and its generality. Another third part illustrates the centrality of the mind as a procedural tool in the criticism of Sunnah according to the modernist. The conclusion lied in the criticism of this practice and in the illustration of what it added to religious knowledge, the value of this addition, and its potential benefit in religious life.
