شرع الله تعالى التعزير أو التأديب الذي هو عقوبة دون الحد، لمن أتى بما يوجبها، وترك للحاكم أو نائبه اختيار العقوبة المناسبة لحال الجاني، نوعا، وكما، وكيفا، بحيث يتحقق بها ردعه وزجر غيره من أفراد المجتمع الذي ارتكبت فيه الجريمة، وبحيث يتناسب التعزير والمفسدة التي أحدثها الجاني بجرمه، كما يراعى فيها حال الجاني أن كان من سطة القوم أو من أشرافهم، وقد تكون العقوبة التعزيرية إلزام الجاني بالقيام ببعض الأعمال التي هي من قبيل القرب، كإزالة الأذى من الطريق، أو تعبيده، أو تقديم ما يتحقق به إشباع حاجات أسرة أو أكثر، من الطعام والشراب والكساء والدواء، أو تكليفه ببناء ما تهدم من مرافق مسجد، أو نقل الزكوات إلى مستحقيها، ونحو ذلك، وقد خصص هذا البحث لبيان أحكام هذه العقوبة التعزيزية.
