المستخلص: This study includes a legal treatment of the reasons that led to the adoption of the general principles governing the process of making public transactions, whether at the international and national levels such as consolidating transparency, preserving the public interest, achieving permanent partnership in the process of trade exchange, and achieving high quality work at an optimal cost. After that we study the goals that are desired to be achieved through the strict application of these principles in the field of regulating public procurement.
This study also includes a detailed presentation of the general principles of organizing public deals, starting with the principle of freedom of access to the public order, the principle of transparency in procedures, and finally the principle of equality between candidates.

Il s’agit de remèdes juridiques pour les raisons qui ‘ont conduit a l’adoption des principes généraux qui régissante le processus de passation des marchés publics, à la fois au niveau international, ou national comme consolider la transparence, et de maintenir l’intérêt publique, et de concrétiser des partenaires durables dans le processus du commerce, qui se terminer avec une haute qualité. Ensuite nous étudions les objectifs atteindre par l’application stricte de ces principes dans le domaine des marchés publics.
Il s’agit également une présentation détaillée des principes généraux qui régissent processus de passation des marchés publics, à commencer par le principe de la liberté d'accès à la commande publique, le principe de transparence dans la procédure, et enfin, le principe d'égalité entre les candidats..


تتضمن هذه الدراسة معالجة قانونية للأسباب التي أدت إلى اعتماد المبادئ العامة التي تحكم عملية إبرام الصفقات العمومية، سواء على المستوى الدولي، أو الوطني كترسيخ الشفافية، والحفاظ على المصلحة العامة، وتحقيق الشراكة الدائمة في عملية التبادل التجاري، وتوخي إنجاز أعمال بجودة عالية، وبكلفة مثالية. ثم نقوم بدراسة الأهداف المرجو تحقيقها من خلال التطبيق الصارم لهذه المبادئ في مجال تنظيم الصفقات العمومية.
كما تتضمن هذه الدراسة أيضاً عرضاً مفصلاً للمبادئ العامة لتنظيم الصفقات العمومية، بدءاً بمبدأ حرية الوصول إلى الطلبية العمومية، فمبدأ الشفافية في الإجراءات، وأخيراً مبدأ المساواة بين المترشحين.
