المستخلص: إن توسع المبادلات الاقتصادية وظهور المنتوجات المعقدة التصنيع التي تتميز بخصوصيات فنية وتقنية وتكنولوجية، والتي يجد أمامها المستهلك العادي عاجزا عن فهم مكوناتها، قد رتب اختلال التوازن بين المستهلك كطرف ضعيف في العلاقة الاقتصادية وبين المتدخل الذي يهيمن على تلك العلاقة بقوته الاقتصادية وكفاءته التقنية في مجال الإنتاج والتوزيع. لأجل ذلك تدخل المشرع بإقرار التزام المتدخل بضمان كل ما يعرضه للاستهلاك من منتوجات مدة معينة من الزمن، وهذا في ظل القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش، لاسيما المادة 13 منه، بحيث تم تحديد شروط وكيفيات تطبيق أحكام هذه المادة بموجب المرسوم التنفيذي رقم 13- 378 المحدد لشروط وكيفيات وضع ضمان السلع والخدمات حيز التنفيذ. لذا سيتم تسليط الضوء على مختلف الأحكام القانونية المتعلقة بهذا الالتزام ورصد أهم ما يثار في هذا الصدد من إشكالات. وفي سبيل ذلك سيتم التطرق إلى نطاق تطبيق التزام المتدخل بضمان المنتوجات من حيث الأشخاص والموضوع، ثم إلى شروط وكيفيات تنفيذ هذا الالتزام.

The extension of economic exchanges and the appearance of products with complex industrialization characterized by technological, technical and artistic specificities, in front of which the ordinary consumer finds him self enable to understand its components, has leaded an imbalance between the consumer, as a weak party in the economic relationship, and the interfering who dominates this relationship by his economic power and his technical competence in the domain of production and distribution. That is why; the legislator has intervened admitting the obligation of the interfering to guarantee all what he exposes to the consummation for a defined period, in conformity with the low no 09-03 concerning the protection of the consumer and the fight against corruption, especially the article 13. The conditions and the modalities of the application of the dispositions of this article have been defined according to the executive decree no 13-378, fixing the conditions and the modalities of the execution of the guaranty of goods and services. So the different juridical dispositions, concerning this obligation, will be clarified and the most important problematic will be observed. That is why we will speak about to the framework of application of the interfering obligation of guaranteeing the products vis-à-vis persons and subject, and about the conditions and the modalities of the execution of this obligation.
