We propose in this study a very important subject that had been considered as one of the fundamental conditions to rule in Islam. In the Maghreb and via the fatwa (legal opinion), of Ibn Marzouq the grandson (842AH/1438AD), the descents of Fatima the daughter of the Prophet Mohammed (peace be upon him), from the mother can be honoured and respected in the same level of a descendent from the father. This fatwa gave more chance to many people to ask for more privilege, and they call them Sharif. The Sharif was considered by the scholars of the Islamic Maghreb as noble and honourable statute and a cause to reach the high class in the society. This phenomenon had been extended all over the Maghreb. It became the way for many people to turn into a political project, and then to a social class, that could made supervision on the high value in the community. They enjoys the respect and appreciation at a time when many scholars calls to honour them and look after them, because they are the nephews of the Messenger of Allah (peace be upon him), they had been associated to the rulers and this position had earned them political immunity, and considerable material to privilege them. The issue of ""sharif Ibn Sharifa, the son of the descendent of the prophet"" was one of the subjects that interest the scientific elites (scholars) nearly for one century, which date back to the year (726AH/ 1326AD), for 40 years before the birth Ibn Marzouq the grandson (842 AH/1438 AD), this subject provoke many legal and social debates between scholars in many cities of the Maghreb. These debates produce a socio-cultural movement on this subject, Ibn Marzouq was one of the leaders of this movement, he wrote a book called “Isma’ Assam fi Ithbat asharf lilum” ""make the deaf hearing about the evidence of honour of the mother"", he tried to give many legal and historical evidences to his thesis."
