عنوان البحث: الجمع بين الدليلين، دراسة أصولية. اهتم العلماء رحمهم الله بدفع التعارض المتوهم بين الأدلة، واتخذوا الطرائق العلمية التي يُزال بها التعارض، واتفقوا على أن الجمع بين الدليلين بإعمالهما جميعاً هو من طرق الترجيح، وإن اختلفوا في موقع الجمع بين الدليلين، فالجمهور عدوه أول الطرق وتأخرت رتبته عند الحنفية. وهذا البحث يكشف حقيقة الجمع بين الدليلين، ودراسة الخلاف في موقعه من المرجحات، مع الاستدلال والترجيح، ثم يعرج البحث على أحكام الجمع بين الدليلين والتي أهمها: شروط الجمع بين الدليلين، وطرق الجمع بين الدليلين والتي أصلها واستعملها العلماء، وأحكام تعارض الجمعين. والبحث شمل هذه المحاور مع الاستدلال والتمثيل، ليقرن بين التأصيل والتطبيق. وفي الخاتمة تم استعراض أهم النتائج التي خرج بها البحث والحمد لله رب العالمين.
Research Title: Combining the Two Evidences, “a Fundamental Study”. Scholars, may Allah have mercy upon them, concerned with removing the imagined contradiction among the evidences, and they followed the scientific methods by which the contradiction was removed. They agreed that combining the two evidences, by implementing all of them, is one of the weighting methods, despite their difference in the status of combining the two evidences, the commons considered it the first of the methods, but Hanafis did not rank it the same. This research reveals the truth about combining two evidence, studying the disagreement in its status, with inference and weighting. The research deals with the provisions of combining the two evidences, the most important of which are; conditions for combining the two evidences, methods of combining the two evidences, which were rooted and used by scholars, and the provisions of contradict in combining the two evidences. The research covered these sides, with inference and reasoning by analogy, to link between rooting and application. In conclusion, the most important findings which are reached by this research are presented.
