المستخلص: يتعلق موضوع البحث بباب مهم من أبواب الشريعة الإسلامية معلوم من الدين بالضرورة ألا وهو باب الزكاة وسيركز الباحث على ما ورد في مصطلحات العنوان من خلال إثبات أن مقاصد الشريعة متعددة في كل أقسام الفكر الإسلامي، ولا تقف كما يعتقد البعض في أبواب المعاملات والعادات، بل تتجاوزها إلى العبادات أيضا، وإن كان الأصل في العبادات التعبد دون النظر إلى المقاصد والمعاني، بيد أن المقاصد والمعاني والحكم موجودة في العبادات كما هي موجودة في غيرها، ثم تطرق البحث لأثر الزكاة في تربية الأنفس وتزكيتها، وتنمية المال وزيادته، وأن الزكاة من أنجع وأنجح الطرق للقضاء على بعض الظواهر السلبية في المجتمع، ويهدف هذا البحث إلى توضيح أن مصطلح المقاصد، ليس قاصرا على المعاملات؛ بل هي موجودة أيضا في العبادات، وإيضاح لمصارف الزكاة مقاصد يجب مراعاتها، وأن لهذه المقاصد دورا في غرس روح البذل والتضحية والعطاء والجود والكرم، وتفصيل القول في المقاصد الشرعية التفصيلية التي يسعى الشرع الحكيم إلى تحقيقها من خلال تشريعه لمصارف الزكاة، والتي هي مقاصد تنطلق من الباعث التعبدي الأصلي لينتظم معه المقصد التربوي الأخلاقي، ويعضده المقصد الاجتماعي التكافلي المكمل للمقصد التنموي الاقتصادي الخادم لمقصد الرسالة المحمدية الدعوي، والتعبدي، ومن أبرز النقاط التي توصل إليها الباحث أن الشريعة الإسلامية كان في وضعها لمصارف محددة للزكاة دورا فاعلا واختيارا ربانيا وهاما سواء أكان على مستوى الأخلاق والسلوك أو على مستوى الاقتصاد، والتنمية، وهذا ما تتميز به شريعتنا الغراء، أنها تخاطب الروح والعقل، وتهتم بالمادة والخلق.

This paper deals with the Section of Alms, referred to as Al-Zakat; one of the important Islamic Law Sections which occupies a significant position in the Islamic Religion. The scholar will focus on the terminology stated for the subject matter through proofing that the purposes of the Islamic Law, known as Sharia, are miscellaneous in all sections of the Islamic Thought. And that these purposes, contrary to what some believe, do not only apply in the sections of transactions and customs. However, they extend them to Worship Section despite the fact that the core essence of worshiping is worship itself, regardless of purposes and meanings, taking into consideration that purposes, meanings and judgment are found in worshiping practices, and others as well. Next, the scholar will highlight the impact of alms in the edification and education of the human self, and its role in development and growth of money, and that alms is one of the most effective and successful methods in eliminating some negative aspects in the society. The research also aims at clarifying that the term of purposes is not limited to transactions, but also employed in worshiping practices, and that alms rules have certain purposes that must be taken into account. Such purposes play a vital role in motivating people to give for free, sacrifice, help the needy and be generous. In addition, it is essential to precisely demonstrate that there are several issues to be considered when it comes to the detailed Islamic Legitimate Purposes that the Islamic Religion seeks to achieve through the legislation of alms regulations. These purposes or intentions stem from the worshiping motivation, with which the educational/ethical intention aligns with, and which is supportive by the social and symbiotic intention, complementary to the economical, developmental purpose that serves the worshiping and advocacy purpose of the Mohammedan message. Of the most important points highlighted by the scholar is that identifying the alms rules by the Islamic Law has an effective role and an important selection by God, whether at the level of behavior and ethics, or economics and development. In fact, what distinguishes the Islamic Law is that it addresses the mind and soul together, and cares for both creation and material.
