المستخلص: يهدف هذا البحث إلى إبراز كيف يؤثر المركز القانوني لرئيس الجمهورية على فعالية الرقابة الدستورية، وإبراز كيف تدارك المؤسس الدستوري من خلال التعديل الدستوري لسنة 2020 ضبط هذا المركز القانوني في مدى خضوع الأعمال الصادرة عنه للرقابة الدستورية والإشكالات التي تم بها تحويل المجلس الدستوري إلى محكمة دستورية كجهاز رقابي أكثر استقلالية عنه. تم التوصل من خلال معالجة البحث إلى جملة من النتائج في أبرزها أن رئيس الجمهورية يمارس سلطة فاعلة ومؤثرة في تحقيق فعالية الرقابة الدستورية سواء من خلال ممارسته للرقابة السياسية لها أو من خلال توظيفه لصلاحياته الدستورية التي من شأنها التأثير عليها بصورة مباشرة وغير مباشرة وفق العديد من المستجدات التي حملها التعديل الدستوري لسنة 2020.

This research aims to highlight how the legal position of the President of the Republic affects the effectiveness of constitutional oversight. Another objective is to shed light on the means by which the constitutional founder has corrected through the constitutional amendment of the year 2020. Controlling this legal position in the extent to which the actions issued by him are subject to constitutional control and the problems with which the Constitutional Council has been transformed into a constitutional court as a supervisory organ is more independent of it. Through the present research, a number of results have been achieved. The most prominent of which is that the President of the Republic exercises effective and influential authority in achieving the effectiveness of constitutional control, through both his exercise of political control over it or through his employment of his constitutional powers. The latter would influence it both directly and indirectly according to many developments operated by the constitutional amendment for the year 2020.
