تهدف هذه الدراسة إلى الكشف عن الامتياز كأهم إصلاح سارعت إليه الجزائر بعد الاستقلال لتحسين وضعية العقار الفلاحي ونظامه القانوني كعقد إداري مؤقت ذو محل معين يتكون من الدولة المانحة وصاحب الامتياز ويخضع لشروط يحددها دفتر شروط تعده السلطة العامة ويتعهد صاحب الامتياز باحترامه، وتتعلق هذه الشروط بالمحل وهو الأراضي الخاصة للدولة، وبصاحب الامتياز الذي يتعين أن يكون شخصاً طبيعياً يلتزم بإدارة المستثمرة الفلاحية شخصياً واستغلالها في النشاط المخصص لها ودفع الإتاوة، كما يمكنه رهن العقار وتوريثه والحصول على رخص التعمير.
