المستخلص: Le créancier peut saisir tous les biens du débiteur en gage de ses dettes, toutefois si la créance objet de la saisie n’est pas proportionnelle a la valeur des biens saisis, le débiteur peut demander, sois le cantonnement de la saisie sur certains biens dont la valeur couvre le montant de la créance et des frais, ou bien le dépôt d’une somme d’argent égale au montant de la créance pour laquelle la saisie a été opérée ainsi que les frais entre les mains de l’huissier.

The creditor can seize all the property of the debtor in security of his debts, however if the claim object of the seizure is not proportional in the value of the seized properties, the debtor can ask either the stationing of the seizure on the certain properties, the value of which covers the amount of the claim and the expenses, or the deposit of a sum of money equal to the amount of the claim for which the seizure was made as well as expenses in the hands of the bailiff.

يجوز للدائن الحجز علي جميع أموال المدين حفاظا على الضمان العام لديونه، غير أنه إذا كانت قيمة الدين المحجوز من أجله لا تتناسب مع قيمة الأموال المحجوزة، جاز للمدين أن يطلب إما قصر الحجز على بعض هذه الأموال التي تغطي مبلغ الدين ومصاريفه، وإما إيداع مبلغ من النقود يساوي الدين المحجوز من أجله والمصاريف بين يدي المحضر القضائي.
