المستخلص: Malgré la simplicité apparente qui suggère la référence au critère organique par le législateur algérien pour répartir les compétences entre les juridictions d'ordre ordinaire et celles d'ordre administratif, cette étude a mis l'accent sur l' énormes problèmes qui apparaissent dans la pratique judiciaire, et qui appellent à un réexamen de ce choix afin de réaliser la corrélation entre la loi applicable et la juridiction compétente, et consacre, par conséquence, l'un des objectifs visés par l'adoption du régime dualiste

رغم البساطة الظاهرية التي يوحي بها اعتماد المشرع الجزائري على المعيار العضوي كضابط لتوزيع الاختصاص بين جهات القضاء العادي وجهات القضاء الإداري، إلا أن هذه الدراسة سلطت الضوء على أهم الإشكالات التي أفرزها واقع العمل القضائي، والتي تستدعي إعادة النظر في هذا المعيار على نحو يحقق التلازم بين القانون الواجب التطبيق والقضاء المختص، ويكرس بالنتيجة أحد أهم الأهداف المتوخاة من تبني نظام الازدواجية القضائية.

Despite the apparent simplicity that suggests the reference to the organic criterion by the Algerian legislature to allocate jurisdiction between the courts usually order and those administrative, this study has highlighted the huge problems that appear in judicial practice and call for a review of this choice in order to realize the correlation between applicable law and jurisdiction, and devoted, consequently, one of the objectives of the adoption of the dual system.
