المستخلص: أهداف البحث: تهدف الدراسة إلى التعريف بمفهوم المخالفة وبيان أهميته، وحجيته وأقسامه وسياق الأمثلة عليها من القرآن الكريم والسنة النبوية، وإثراء مسائل أصول الفقه بإظهار أدلة لها من السنة لم يذكرها الأصوليون، وأيضاً ربط القواعد الأصولية بالأحاديث النبوية. أهمية البحث: أن في إثبات القواعد الأصولية بالسنة إيضاح لاستناد هذا العلم إلى السنة على وجه الخصوص، وأيضاً أن الدراسة في مثل هذا الموضوع تنمي لدى الباحث الملكة التي يتمكن بها من ربط القواعد الأصولية بالأحاديث النبوية، وأيضاً أهمية مبحث مفهوم المخالفة في علم أصول الفقه فهو يمثل أحد مباحث دلالات الألفاظ. منهج البحث: اعتمدت في هذه الدراسة على المنهج الاستقرائي. أهم النتائج: خلصت الدراسة إلى جملة من النتائج أهمها؛ بيان المراد بمفهوم المخالفة وهو دلالات اللفظ على ثبوت نقيض حكم المنطوق للمسكوت. لمفهوم المخالفة أسماء متعددة هي: دليل الخطاب، المخصوص بالذكر، فحوى الخطاب، تنبيه الخطاب، لحن الخطاب. أن لمفهوم المخالفة أقسام بلغ عددها ستة أقسام هي: مفهوم الصفة، ومفهوم الشرط، مفهوم الحصر، مفهوم العدد، مفهوم الغاية، مفهوم الغاية، مفهوم اللقب، جميع هذه الأقسام حجة على القول الراجح ماعدا مفهوم اللقب. أن هناك شروط للعمل بمفهوم المخالفة بعضها يرجع إلى المنطوق، وبعضها يرجع إلى مفهوم النص المخالف وقد اختلف العلماء في تعداد هذه الشروط، حيث بلغ عدد الشروط التي ترجع إلى المنطوق ثلاثة عشر شرطاً، وبلغ عدد الشروط التي ترجع إلى مفهوم النص المخالف أربعة شروط. اختلف الأصوليون في الاحتجاج بمفهوم المخالفة، وبعد البحث والدراسة تبين رجحان القول القائل بأن مفهوم المخالفة حجة. قوة مفهوم المخالفة لورود الاستدلال على حجيته في الكثير من الأحاديث النبوية، وقد بلغ عدد الأدلة المستدل بها على ذلك ثلاثون دليل صحيح وردت في صحيح الإمام البخاري والإمام مسلم. أهم التوصيات: يوصي الباحث بضرورة إثراء مسائل أصول الفقه بالاستدلال لها من بأدلة من القرآن الكريم والسنة النبوية.

Research objectives: The study aims to introduce the concept of contravention, its importance, its authority, its divisions, and the context of examples from the Noble Qur’an and the Sunnah of the Prophet. Also, to enrich the issues of jurisprudence by showing evidence of it from the Sunnah that was not mentioned by the fundamentalists, and also to link the fundamental rules with the hadiths of the Prophet. Research Importance: In proving the fundamentalist rules of the Sunnah is an explanation of the reliance of this science on the Sunnah in particular, and also that the study on such a subject develops with the researcher a conclusion with which he will be able to link the fundamentalist rules with the hadiths of the Prophet, and also the importance of the study of the concept of contravention in the science of Usul Al-Fiqh, as it represents one of the investigations Semantic. Research methodology: This study relied on the inductive approach. Main results: The study concluded with a number of results, the most important of which are: Explaining what is meant by the concept of contravention, which is the indications of the wording for proving the antithesis of the operative judgment of the silent. The concept of contravention has several names, which are: The discourse guide, particular mention, the content of the speech, the warning of the speech, and the tune of the speech. The concept of contravention has six sections, which are: The concept of the adjective, the concept of the condition, the concept of constraint, the concept of numbers, the concept of purpose, the concept of purpose, the concept of the title, all of these sections are an argument for the most correct saying except for the concept of the title. There are conditions for working with the concept of contravention, some of which refer to the spoken word, and some of them refer to the concept of the contradictory text. Also, scholars differed in enumerating these conditions, as the number of conditions that refer to the operative reached thirteen conditions, and the number of conditions that refer to the concept of the contradictory text reached four conditions. The fundamentalists differed in invoking the concept of disagreement, and after research and study it became clear that the saying that the concept of contravention is an argument is more likely. The power of the concept of contradiction is because of the evidence for its authority in many of the hadiths of the Prophet. Also, the number of evidences inferred for this has reached thirty authentic evidence that was mentioned in the Sahih of Imam Al-Bukhari and Imam Muslim. The most important recommendations: The researcher recommends the necessity of enriching the issues of fundamentals of jurisprudence by inferring them from evidence from the Holy Qur’an and the Prophet’s Sunnah.
