المستخلص: يكتسب موضوع اللجوء أهمية كبرى في أجندة الدراسات والأبحاث الأكاديمية، نتيجة تزايد عدد اللاجئين في الآونة الأخيرة، الذين يلتمسون الحماية من دول أخرى، فأصبحت ظاهرة اللجوء ترهق كاهل الدول لما تخلفه من قضايا ومشكلات دولية، وتعرض حقوق اللاجئ لانتهاكات سواء بطريقة مباشرة أو غير مباشرة، الأمر الذي جعل المجتمع الدولي يتدخل بوضع قواعد والتزامات للدولة الملجأ تحمي بها حقوق هؤلاء. وفي السياق ذاته، تأتي هذه الورقة البحثية لدراسة ظاهرة اللجوء من حيث امتداداتها التاريخية وأسبابها وأشكالها والأطر القانونية المنظمة لها في ضوء القانون الدولي وسياسات التعاطي معها من خلال دراسة موقف المجتمع الدولي من الظاهرة خاصة في ظل تنامي الظاهرة وتعدد أشكالها والتعرف على تعاملات الدول المستقبلة مع اللاجئ من زاوية حقوق الإنسان، للبحث في جدلية البقاء (حق اللاجئ في العيش الكريم)-الترحيل( حق الدول في الحفاظ على أمنها).

The Asylum issue has occupied the agenda of academic studies and research, and has become a burden on other countries, due to the international problems it has left behind, and the violation of refugees rights to direct or direct violations, which prompted the international community to intervene. Strongly to develop a legal system that protects their rights. In the same context, this research paper comes to study the phenomenon of Refuge in terms of its historical extensions, causes, forms, and legal frameworks regulating it in light of international law and policies of dealing with it by studying the position of the international community on the phenomenon, especially in light of the growing phenomenon and its multiplicity, and identifying the receiving countries' dealings with the refugee. From a human rights standpoint, to discuss the argument of survival (the right of a refugee to a decent life) - deportation (the right of states to maintain their security).
