تعد فتاوى الوقف من أوسع المصادر الدالة على تفاصيل أحكام الوقف وقضاياه؛ نظراً لقلة عدد النصوص الواردة في الوقف، فاعتمد على الاجتهاد والفتوى اللذين تعاضد فيهما فقه الواجب مع فقه الواقع. وكان لفتاوى الوقف الأصيلة دور مهم في الاستجابة للنوازل بعد الصدر الأول، والتصدي لمشكلات الوقف، والحفاظ على أعيانه، وتثمير موارده، وحفظ حقوق مستحقيه، وتحقيق مقاصد شريعة الوقف، والتعاضد مع القضاء الوقفي في ضبط نظام النظارة الوقفية وتطويره. وعملت الفتوى الوقفية الحديثة على التنبيه على فقه الأولويات الوقفية والتنموية، والإفادة من الإمكانات المتجددة في توسيع رقعة الأوقاف، باستحداث صور وقفية جديدة تجتذب المزيد من الشرائح، وتعظيم دورها التنموي في دعم قضايا الأمة وحل مشكلات المجتمع، وتعظيم الموارد الوقفية باستثمار إمكانات الاقتصاد والمالية الإسلامية، ما أدى إلى خدمة القطاع المصرفي، واستحداث صور مالية مشتقة من النظم الإسلامية بلغت ذروتها في البنوك الوقفية، ما وضع الوقف في صلب مرتكزات الاقتصاد المعاصر، وهو ما يدعونا إلى إعادة النظر في نظرية المال الإسلامية، بما يستوعب الرصيد التنموي الذي يضيفه النظام الوقفي إلى نظريات الاقتصاد الإسلامي.
