|a رغم أن أسلوب الحماية الجنائية هو الأسبق تاريخيا في تنظيم الحماية القانونية الناشئة عن الابتكار الذهني الأمر الذي أدى إلى رجحان كفته على حساب الحماية المدنية سواء في ظل نظام الامتيازات الممنوحة للمطابع أو مع بداية تقنين حق المؤلف الحديث، إلا أن هذه الصورة عرفت تغييرا جذريا في التشريعات المعاصرة، إذ تعود الحماية الجنائية كأحد الحقوق الممنوحة للمؤلف بالنفع على المجتمع ككل، فهي تساهم بشكل كبير في تطور المجتمعات ثقافيا واقتصاديا وعلميا، كما تؤدي إلى إثراء التراث الثقافي والعلمي الوطني والعالمي، والذي يخدم كافة القطاعات الأكاديمية والاقتصادية والصناعية التي تسعى إلى الرفعة والمكانة بين الأمم.
