al-Muntaqā min al-Sunan al-Musnadah by Abū Muḥammad ‘Abd Allah ibn ‘Alī ibn al-Jārūd al-Naysābūrī (d. 307 H) is well-known among hadith scholars as one of the most important compilations in sound hadith. However, at least 82 hadith in this compilation has been found as weak rising a question on their role and function. This article aims to identify the conception held by Ibn al-Jārūd regarding the role and function of weak hadith in legal discourse. This research applied library method by adopting the process of qualitative analysis. The study finds that every weak hadith mentioned by Ibn al-Jārūd in this work plays a very subtle role in his comprehensive argument. Despite he did not accept weak hadith as a legal argument independently, he accepted them as supporting arguments. Ibn al-Jārūd is seen uses weak hadith to motivate good and discourege evil (targhīb wa tarhīb), as well as to provide information which completes, details, and interprets the contents of authentic hadiss used as main argument. This practice is in line with the view of the majority of hadith scholars who do not reject weak hadith entirely but to use it in selective manner.
