|a قد تنشأ ظروف استثنائية تمس بأمن الدولة وسلامة شعبها ومؤسساتها، تبرر لها فرض تدابير استثنائية، تخرج من خلالها عن القواعد التي تطبق في الظروف العادية، لهذا رخصت عدد من الاتفاقيات الدولية في مجال حقوق الإنسان للدول الأطراف فيها بالتحلل من بعض أحكامها، لكن قيدت تلك الرخصة بشروط لضمان التوازن بين الهدف من التدابير الاستثنائية، وهو التصدي للخطر الذي يهدد كيان الدولة، وبين ضمان حماية حقوق الإنسان، بينما لم تتضمن بعض الاتفاقيات على غرار الميثاق الإفريقي لحقوق الإنسان والشعوب مثل تلك الرخصة. حاولنا من خلال هذه الدراسة البحث في إمكانية تحقيق ذلك التوازن سواء في وجود تلك الرخصة أو في غيابها.

|b Exceptional circumstances may arise that affect the security of the state and the safety of its people and institutions; may justify the imposition of exceptional measures. this is why a number of International conventions in the field of human rights have authorized the states parties to dispose of some of its provisions but that license was restricted on conditions to ensure a balance between the objective of the exceptional measures. and to address the threat to the entity of the state and ensuring the protection of human rights. while some conventions such as the African charter did not include such a license. In this study we tried to investigate the possibility of achieving this balance in the presence of such license or on its absence.
